NOTICE TO VENDORS AT KALAPANA
This notice is to inform you that the County will initiate enforcement of the law that prohibits commercial activity within any County right-of- way. Pursuant to Hawai‘i County Code (“HCC”) §22-2.5, no portion of a County street, which includes any “county owned and maintained street, highway, or right of way,” shall be used for purposes of vending, selling, renting or leasing any goods, wares, food, merchandise or other kinds of property. Enforcement is necessary to alleviate bicycle accidents and disruption to residents in the area.
The County will strictly enforce the provisions of HCC § 22-2.5 beginning July 1, 2018.
By that date, all vendors currently operating on the roadway or shoulders must vacate all portions of the roadway. Failure to comply with this deadline may result in monetary fines as provided in HCC § 24-16.
The County intends to move the parking area for vehicles to the second gate of Highway 130 to reduce the walking or biking distance to the park boundary. The County will provide guidance to vendors who wish to continue to operate on suitable locations off the roadway.
An informal community meeting will be held to address any outstanding concerns or questions as detailed below:

Location: Pahoa Community Center
Who: Affected entities and County personnel

Wow. The county is hell bent to squash anyone trying to make a simple living. Someone at the county has a hard on.
If I was a bike rental vendor at Kalapana I would want to see the county survey the road to determine just who is standing where. There's a good chance the road itself is outside the county right of way.
Speaking of violating rights of way... in Pahoa Village the main road right of way boundry is about four feet INSIDE Boogie Woogie Pizza and other shops on that stretch.
I know, I've seen the survey.

Given that it's a State highway, I'm sure this is a typo, and they meant "owned or maintained".

I'm sure there's a park nearby where the vendors can relocate.

Fortunately for County/State, adverse possession doesn't apply to government-owned land, so they can just bulldoze all those "quaint historic shoppes" at whim.

With the county it's all about location, location, location. If you find a good one to sell your wares, pack it up and move.
Their notice didn't even mention flammable tarp inspectors, no doubt still to come.

Also ("ironically") they're targeting the high-visibility roadside vendors that attract tourists.
Vendors in Kurtistown are unaffected (so far), and some of them even have pop-up tents.
