Pot Patients Names & Addresses Released to Tribune - Guest - 07-01-2008

...according to a database that the Department of Public Safety provided to the Tribune-Herald on Tuesday that lists the name of each patient...

So when are peoples Medical Records available to newspapers?

So much for medical records being confidential.

If the Newspaper can access them, so can anyone else I would assume.

This just gives a list to Federal Agents on Houses to possibly raid.[:0]

DPS information is public... I will have to read up on the Hawaiian weed laws. But my guess is you have to register with the DPS so if they catch you with some you don't go to jail.
The Freedom of Information Act might apply here also.

I still don't see anything here that would allow a doctor to release medical information to anyone.

The following is an excerpt from here

A face to face history and good faith examination of the patient from a Hawaii licensed physician is required to complete the medical marijuana evaluation for recommendation or approval of medical marijuana. This primary care provider must develop a treatment plan with objectives, discuss side effects of medical marijuana and perform periodic review of the treatment's efficacy. This primary care provider should use consultation, as necessary, and provide proper record keeping that supports the decision to recommend the use of medical marijuana. Your $25 prequalification fee can apply to our Medical Marijuana evaluation fee of $125 should you choose the service of our Hawaii Licensed physician. ($25 now, and $100 when you visit the Doctor).

Here lies the stickler...

Patients and their primary caregivers will be required to register annually with the Hawaii Department of Public Safety


Why do people need to register with the Hawaii Department of Public Safety? If this is a Medical condition, then should they be registering with the Department of Health?

Public Safety brings in the Law Enforcement side of things.

I Doubt the Department of Health would release medical records.

To put it in perspective, the law covers those with medical conditions from the release of information about the medical condition. It does not protect a person from the release of information that a medical condition exist within government.
Example: Motor Vehicles is not legally prohibited from disclosing those with Disable Parking privileges, but they can not release the medical reason that person is considered disabled.

It does not matter if you are for or against a certain "HERB" (person or plant).

It does not matter if you are for or against "privacy rights" and making sure we know were those terrorists "HERBS" (persons or plants) live.

It DOES MATTER that a newspaper that JUST reported/printed a HOME INVASION story where a person was threatened at KNIFE POINT looking for "HERB".
Would THEN have so little CONCERN of what could/will happen if they reported/printed a way to obtain a list of the names and addresses of "HERB's" whereabouts. [B)]

With the economy in such a downturn can we afford the sudden rise in "consumer prices" this will cause!

Pit Bulls will be sold by the gram.

Fencing by the centimeter.

Electrical rates will skyrocket with additional motion sensitive security lights usage.

More smelly people in line because they can't afford to both heat their water and guard "HERB" (something has to go).

Sigh!

I am a retired(thank God) Police officer and I find this to be irresponsible reporting. I don't agree with some of you but do think this is way over the line.

That is a major violation of H.E.P.A laws that were established federally to protect doctor patient confidientiality. It was created to protect those with diseases that they could threaten their life, livelyhood, their community, their home.
For example if some one who has H.I.V or AIDS or CANCER, if it was to leak out to the community it could get a person or family KILLED.
The fines ar huge in the tens of thousands and prison .
Their should be some major trouble brewing for this brewha.

And as far as homeland security and Patriot Act, Some of or Grandparents have live through a time not much different from today,does the name Hitler ring a bell. with that said I wont speak any more on that subject in fear of the current Gov. I enjoy my privacy and my life,

It's not right and unfortunate... but, DUH?! Who didn't know that their names were being collected and handed over to the government when they signed up for a medical marijuana permit?
