Don't break the law and talk on your cell phone while driving. It's pretty easy. Before cell phones came along people somehow managed to drive without texting or talking on the cell phone 100% of the time.

Riverwolf said he was not talking on his phone yet still got a ticket if you read his post.

I use the speaker and don't hold the phone to my ear. Don't like hands free devices. Driven right by lots of cops doing this. No problem.

I was pulled over a few months ago on #130. Officer insisted I was on the phone. Would not let me show him my phone and call record.
Went to court and the judge would not look at my phone record that showed I had not made any calls for two hours before I was cited.
He fined me $97 and told me I could appeal if I wanted!
First ticket in over 25 years and for somethng I wasn't doing.
Ironically while I waited my turn to stand before the judge, over half a dozen younger local boys most of which had "attitudes" had "driving without a license and no proof of insurance" charges. Some were there for a second time and one was on his 5th violation.
All were charged $450 with $400 suspended ... so they only paid $50.
The judge told them "if they no can pay" they can do community work. Lesson learned: talk on cell ph.(or not) and be polite to the judge $100 fine. Drive with out a license and no insurance, over and over again, have a wannabe gansta attitude.. $50

Add in driving drunk - and you most likely will receive a get out of jail card free!!

What really pisses one off is to get a ticket for not stopping at the stop sign at the Maku'u/130 merge. Cop tells me that "yeah, I could sit and write tickets there all day long because nobody stops there". I write a letter about the ticket hoping to get the $130 ticket reduced back in December when I got the ticket. Man at the counter says "it will take about 2-4 months to process"..... Well, last week I got a call from a collection agency in Texas that is representing the County of Hawaii.... I owed $57 bucks for the ticket I got and another 19 buck in processing fees!!! I never got a letter from the county as to WHAT the fine was going to be! Before I paid the collectors, I went to the county office and wanted to find out what the hell was going on... They claim there was a letter sent out in December and since I didn't follow up they just sent it to collection without a follow up letter or phone call... The man said "write a letter"... Knowing how long things take, I paid the funds to the collection agency and had plans to stop by the court house to see if I could talk to a supervisor.... Today in the mail comes the "LETTER" that should have come in December and tells me they reviewed my letter and made a judgement of $57 dollars!! WTF???!!! The letter is post marked "APRIL 22nd"!!

As soon as I calm down a wee bit I'm going to call and talk to the highest ranking person there and chew some ass!!

Yeah, I'm a bit pissed!!

Royall and riverwolf, if you two would just follow the law!!! Smile Smile Smile

Seriously, that's terrible what you guys went through. It actually ticks ME off and I don't even know you.

Moral of the story: following the law is the prudent option; just don't bank on it keeping you out of trouble.

Adding insult to injury, why are we subsidizing jobs for a collection agency in Texas?

For the same reason property taxes are processed in Seattle?

Seems like something that could be done locally, maybe create jobs or something.

I know Riverwolf, and already knew about this ticket. However I was not responding to HIS post. I was responding to the thread.

Okay, so you already knew he got that ticket and how completely unjustified it was. Yet you stated how easy it was to avoid a ticket by obeying the law.

RE: driving & using cell phone trap in Hilo - dayna - 04-25-2013

It is much easier to avoid a ticket by obeying the law than it is to break it. Yes.
I was not talking about Rivers situation, there were circumstances which made the officer think he was on the phone.

"there were circumstances which made the officer think he was on the phone"

I thought so. If a cop wants to hand out tickets for cell phone use he sure doesn't have to pick on people with ugly bumper stickers.
