Hypothetically speaking, if the incident described by Malolo were to have happened to me at my at my place of residence, would I be within my rights within the State of Hawaii to blow the guys head off with a shotgun?

Living not too far away from 1st, this is scary to hear but I am glad to hear about it. Also very happy everyone in the house was safe. We need to know about these things. Media does a piss poor job covering these type of incidents.

Sorry beejee, you only have the right to use a shotgun if some has a shotgun on you first, and you better pray that you have a permit for that shotgun and have it registered at your local police station. You can only meet an attack with equal or lesser force if I am not mistaken. If a guy has a machete, but not swinging it at you and you pull out a gun and shoot him, even on your own property, you go away for a long time here in Hawaii.

The exception is if you feared your life was in danger and could prove that you had no way of escape and could not wait for police.

A friend of mine in Washington was being burglarized in the middle of the night, woke up to the dog growling, no barking and standing at the doorway of the bedroom with the door closed. Heard someone going though stuff and making their way from room to room getting closer. The dog was a 70lb female pitbull. Only phone was in kitchen at the time, cell phone in purse in kitchen also.

She opened the door, dog ran out and did what she was supposed to and protected her owner, tore the guy up who was a known junkie that robbed people. She made an escape out of her bedroom window, ran to a neighbors house screaming at the top of her lungs.

She got sued by the junkie. He won also. The dog was also put down because of the nature in which the guy was attacked. The dog was labeled a deadly weapon and a threat to the community if it ever got loose.

The defense? She purposely let the dog out knowing it would be aggressive. State says she should have had signs saying attack dog on property and door should have been left shut.

State said she had no right to open the door and then flee the house. She should have left the house with the dog locked in the bedroom. Yes, they used the word LOCKED. Had the junkie broke down door knowing there was a attack dog on property, he would have been liable for his own actions.

Same goes for here with dogs. Law will side with the criminal in most cases if an attack is involved on the criminal. Quite a few incidents similar have happened here in Hawaii where criminal sued homeowners.

Gotta love these blue states. THEY think YOUR protection should only be provided by the STATE and GOVERNMENT. Next, all registered gun owners will need to post signs up saying they are armed just like we need attack dog signs up if we want our dogs to be protective over our property. All just my humble opinion.

Glad the junkie was caught. Gunna bet meth junkie and not WEED junkie. Only cause Green Harvest does such a good job with those pesky pot heads lol!

I'm wondering how long before someone in Hawaii (or another State with similarly restrictive self defense laws) uses a Joe Biden defense and plays the audio or video of his statements in court. I think it would have jury appeal, hearing the advise coming directly from the Vice President of the USA.

I was thinking the same thing, malolo. $83K is still a lot of money but I thought it would be much higher especially given he seems to have done exactly the same thing before and spent years in jail because of it (I looked up his record on Ho`ohiki). Incidentally, anyone know what "phone ripping" is? I've never heard the term before and if it's to do with him taking the phone from one of the victims, isn't that theft? Just curious.

I am pretty sure a piece of scum like this has a family full of scum along with a bunch of friends of equal scum.

As Tom said - look this guy up on the court system.

Another example of our justice system hand slapping human feces like this guy.

When you look at this guys list of criminal activities, it becomes apparent that his life is that of taking by force anything he wants when he wants.

IMO - there is only one way to deal with a scum bag like this. And it requires bullets.
