RE: Dental Malpractice - ericlp - 06-10-2013 Well, I know dentist have to have pretty good insurance. A letter of intent on an attorney's letterhead can always get the party started. Personally I wouldn't use small claims unless it was the last resort. If I spent that kind of money and from reading your story... I'd want to get my money back as well. Unless you signed something where the small print was you acknowledged the risks or waived your rights ... etc...etc... you could have a good possibility to get money back. I am not sure who I hate more? A dentist or a lawyer? haha But, I agree you could do some research yourself about how to go about this online. I would know how I'd approach it first, but you can find some convincing canned letters and "IF" worded right, they sometimes can have positive results. Before hiring an attorney you have to weigh in your time and costs for risk of any type of settlement. It's hard to put a value on loss of tooth, pain/suffering, etc...etc.... This being all said, no matter who you go with, I always pray that I get good work from a dentist and I'm not even religious. Good Luck! To break agreements like that in the name of justice?? I hope so. Anyway, I've decided to tell you where NOT to go for (at least) root canals. It's Kuhio Dental Group. He also had me on months of antibiotics. Good luck to all of you who are looking for a good dentist. Dr. Sutton was excellent but he doesn't seem to be around anymore. My Endodontist worked hard and long the other day on one of the botched root canals and was finally able to remove a PIECE OF A METAL DENTAL FILE from the root of the tooth! Also, he found that the "dentist" had missed a whole root (nerve). And whomever said dentists don't like to sue each other - you may be wrong because my Endodontist and the nurse both looked disgusted about the metal that was left in my nerve and the massive infection I've been living with for 9 months in the 3 teeth the other guy treated - especially the one with the file left inside.
