Changing a zone to limit a use

Opinion: it's only a "taking" if inflicted by government. If the landowners legitimately ask for it, then it's "will of the people" -- but if they're really unanimous, they can simply write themselves some CC&Rs without involving the government.

My suggestion was just that, a suggestion. In my opinion, it is always easier to get a mutual agreement between the ranchers and the suburbanites in writing before it gets to the point the suburbanites win, with Ag zoning rights kaput, except for the County's definition and tax break.

Ag zoning rights kaput

Two things come to mind.

1. Shipman's massive "ag" lands.

2. Zoning is worthless here anyway. Consider that TMT had "permits" issued by "the government".

I'm setting up a meeting with Harry to discuss the serious infestation of houses in our agricultural areas. These structures always bring vehicles, noise pollution, and messy children to otherwise pristine locations.

Well, I don't live next to a rooster farm, but...... I've seen PLENTY here in beaches/shores area's.

And this is residential lots! Seen plenty in Hilo too for that matter, same zoning. Even *IF* and that is a big if, they did change the zoning for HPP, good luck getting anything done.

I don't live in HPP, but I can relate to people that live next door to them. I hope something can be worked out, but if the cops can't even enforce dog laws that are CLEARLY on the books on this island. How will they enforce any other law?

It's all fun and games till someone loses an eye.

Just a thought on the rooster issue. I'm totally not pro rooster fighting. I love my big old Rhode Island Red rooster! That being said, I frequently have roosters take up residence on my property that I DIDN'T BREED/PURCHASE/OWN. Should I be fined because of that? What if I try to trap them and can't? If I tried to shoot them, the someone would complain about that!

I currently have 6 roosters that have wandered in from the jungle, or because someone dumped them, etc etc that I don't feed but still live around my house on my property. Do they crow? Yes. Does that bother the neighbors? I have no idea. We live on AG land, and roosters happen.

If the roosters aren't chained to miniature A frames, all lined up from one end of your property to the other, it would be hard for detectives to have probable cause, and the DA to prove intent.

You're should be in the clear.
