RE: Scott Nago Solves Democracy Crisis With Magic Basket of Destiny - HiloJulie - 08-22-2026

Who are you asking Rob? Me or MyManao?

I have more or less explained the claims that the original poster asserted and attempted at portraying our Elections Chief as doing something wrong or illegal by explaining the actual laws as it relates to the subject matter, as I have also done on other threads about other legal subjects only to be consistently met with argumentative, taken out of context quotes, personal attacks and other such verbal vomit as well as having to see the general use of consistently very foul language, when telling other posters he disagrees with to take their arguments as it relates to a certain social media website from MyManao.

So, if indeed you are asking me, I would then ask in return, do you NOT see any subliminal vacation asking in any of MyManao's posts? Don't see any possible stress about something? Do you even read his posts?

Heck, even the Tang has pointed out his outbursts of late.

At any event, it seems impossible for MyManao to not do anything other than make his normal noncontributory to the subject matter posts but just sling his personally insulting attacks back and forth, nor will PuanWeb moderation seemingly do anything about it, so I'll make you this promise - no matter what verbal vomit MyManao spews towards me from this point on, I just will not reply.

Oh, not stressed about anything either. Concerned a bit about this weekend's weather impact however, and hope everyone, including you and yours, stays safe.

Deal?

(Pease disregard this post if you were NOT asking me.)

I'd love an example of a you, an individual, making a law.

County's "marijuana is the lowest law enforcement priority" comes to mind.

I have a simple solution for breaking polling ties. Make the contestants take a test based on the State or Federal constitution.
A simple test would be similar to a question posed to people who want to become US citizens:

"What is meant by the Rule of Law?"

Answer by Melania Trump's mom: "Sir, the Rule of Law$ is when you want to cross the border without a passport. You offer the border crossing guard a crispy $100 Ben Franklin bill, with the assurance you know how the law really works."

Ah, yes, kalakoa, but (I thought at least) with the earlier poster going on about legislators, senators, and the governor it was clear that my post/question was directed to State.

And, yes, County does have, although it is used far less than it could (one could say should) be, referendum. That's why I titled my earlier post over on the political board An ode to Jerry Rothstein. Jerry used, was a champion of, County's right to referendum. And although the bills he got on our ballot weren't always successful he sure worked long and tirelessly to make them happen. His Save Hapuna drive to get signatures was exemplary. And although the bill lost, Jerry sitting there day after day in the parking lot at Hapuna gathering signatures was a real life testament to what one person can do.

If only we had the right to referendum on the state level. Then yes, an individual could write state law that could cause change in consequential ways. But without it, an individual, without deep pockets and deep connections, is powerless.

I have a simple solution for breaking polling ties.

Checkers?
Blue and red pieces.
Televised on cable access.
Before each move ask “a question posed to people who want to become US citizens:”

Winner wins their race. The rest of us get to see how qualified they are.

I have a simple solution for breaking polling ties.

Until such time as the voters elect representatives and senators willing to change the law, the only current solution is to do exactly what Scott Nago did.

It's called HRS §11-157:

In case of tie. In case of the failure of an election by reason of the equality of vote between two or more candidates, the tie shall be decided by the chief election officer or clerk in the case of county elections by lot.

As is the law in 27 other states.

For roughly two decades, there was a different law.  Prior to 2012, the process was not based on chance, so it at least had more of a veneer of legitimacy, with a result determined by voters instead of by a process possessing the optics of a fundraiser raffle.

§11-157 In case of tie.
In case of the failure of an election by reason of the equality of vote between two or more candidates, the tie shall be decided by the chief election officer or county clerk in the case of county elections in accordance with the following procedure (1) In the case of an election involving a seat for the senate, house of representatives, or county council where only voters within a specified district are allowed to cast a vote, the winner shall be declared as follows (A) For each precinct in the affected district, an election rate point shall be calculated by dividing the total voter turnout in that precinct by the total voter turnout in the district. For the purpose of this subparagraph, the absentee votes cast for the affected district shall be treated as a precinct. The election rate point shall be calculated by dividing the total absentee votes cast for the affected district by the total voter turnout in that district. All election rate points shall be expressed as decimal fractions rounded to the nearest hundred thousandth;(B) The candidate with the highest number of votes in a precinct shall be allocated the election rate point calculated under subparagraph (A) for that precinct. In the event that two or more persons are tied in receiving the highest number of votes for that precinct, the election rate point shall be equally apportioned among those candidates involved in that precinct tie. C) After the election rate points calculated under subparagraph (A) for all the precincts have been allocated as provided under subparagraph (B), the election rate points allocated to each candidate shall be tallied and the candidate with the highest election rate point total shall be declared the winner; and(D) If there is a tie between two or more candidates in the election rate point total, the candidate who is allocated the highest election rate points from the precinct with the largest voter turnout shall be declared the winner;(2) [Similar detailed rate-point calculation for statewide/countywide/federal offices…]

Actually, the tie breaking rule was changed when Act 136, House Bill 1248 was enacted in 2019. Which was also the law that made Hawaii a vote by mail state, which passed with overwhelming support of BOTH parties and BOTH chambers.

Now, having said that, it appears this revised tie breaking law has ruffled most of the same legislators who voted for it in 2019 to now seek a change:

Change to election tiebreaker procedure next session

Democracy in action!

RE: Scott Nago Solves Democracy Crisis With Magic Basket of Destiny - Punatang - 08-22-2026

Actually, the law was changed and modified many times.  At one point before it had the more legit process, it required agreement by both candidates to do a lot/chance process.  That resulted in a stalemate and the law was modified.  Then it went legit, then it went back to being a clown show.  Actually.

RE: Scott Nago Solves Democracy Crisis With Magic Basket of Destiny - HiloJulie - 08-22-2026

What about the law makes it a "clown show?"

The legislators who changed the law? Who Voted on it in an overwhelming majority? BOTH political parties voting in favor of the new law? The Governor who signed it into law? Or the Elections Chief now bound by the very law and obligated to uphold the law?

Where does the "clown show" start and then end?

Sorry Tang, but the law is the law. Your opinion of it is your opinion. One requires you to be bound by it. The other is just simply your entitlement to have.
