Rob, When I wanted to run an ad in the paper about our contractor from HELL, the lawyer I talked to, said we were opening ourselves up to a lawsuit. He advised us to word the ad, exactly how you recommended doing it (see above) I edited my original post in contractors from HELL. Punaweb is too important to us, not worth putting it in jeopardy!

Thank you. I think it practical to make these changes. Let's hear from some more folks. I may consider sending an email to the previous posters asking them to edit/update their posts.

This site is an asset to the Puna community. It would not be wise to risk it.

I changed the name of the thread about contractors.
I might be wrong,but if only facts and neutral language are used,it shouldn't be a problem.

People chiming in because they had a bad experience because of a phone call from 2,000 miles away (or locally) when they have an anonymous name may open up PW to some serious troubles. It's just not balanced for someone to sit here and blast away w/out any checks and balances. I don't have much of a problem if someone uses their real name and are not scared of using it here....but people that hide behind a screen name and then bitch about a company just isn't right.

It's for this exact reason that I won't post a certain person's posts on my blog, because they are just so hateful and yet they won't even disclose who they are.

Most of the times these things are a "He said/She Said" type of incident when none of us were there to see the incidents that could be described.

Now if both parties were posting on Punaweb and could defend themselves fairly then I might think differently about the issue.

That's true about personal communication.But if someone has been scammed and has facts to prove it,should this person keep silent if being asked about the scammer?
Again,if only facts will be presented and no offensive language used...
Of course,it's safer not to say anything.
But let the lawyers on our forum speak.

I started this thread not for myself.Somehow all my life I managed to detect good and honest people in business from the opposite kind. But I can not forget Canhle's friend's story.It could have been all his life savings!
But if this thread will have to be deleted ...So be it.

Bottom line-it's not worth to lose this forum ...even all not-so perfect -contractors will keep doing their not-so-perfect jobs and people like Canhle's fiend will be left with foundation instead of the whole house.
After all -it's their fault -trying to save-right?

There is a real BBB available too. Posting complaints on Punaweb might feel good but taking the action to file
complaints with the Contractor's License Board or police if necessary is much more effective. I also believe
that small claims court is a very good place to seek a little justice. Noting like a judgment to speak volumes.

There is a way to check the DCCA and BBB complaints history of anyone on the web, maybe a permanent posting of the links to those web sites on Punaweb would help. (Rob, I can send you the links if you want them.) In addition, you might want to add some kind of permanent disclaimer on the site, indicating that the opinions expressed here are not endorsed by Punaweb.

Federal law provides that no provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider, 47 U.S.C. ?230©(1), and that no cause of action may be brought and no liability may be imposed under any State or local law that is inconsistent with this section, ?230(e)(3). Convicted in a court of public opinion? Not to cross thread by look at the Billy kenoi true "facts". One side says they have the "facts". The other side says they "dont have the true facts".
