The only difference between public and private roads that fatalities on private roads are not counted in the yearly tally by the County.

Fatalities on private roads aren't counted by the county? How weird is that? Does that mean they don't count homicides, etc., too, on "private property"?

Reality......Hawaii County Police cannot enforce most traffic laws in a private subdivision. They can get creative and write other infractions up, but that's about it. It will never solve the problems in HPP. Ever been to the Kangaroo Court in Keaau? Go check that out and you will see a system that is fundamentally broken. The law enforcement around here does a great job, but the truth is that anyone can screw up as much as they want short of capitol offenses and there will be no accountability handed down by the courts. That is why some people around here have no grasp of "quiet enjoyment rights" and how to act with civility. There are absolutely no consequences......so why behave?

Bob, you are correct. Reference Hawaii County Code 24-2, 24-8 and 24-9 (http://www.co.hawaii.hi.us/countycode/chapter24.pdf). However, HCC 24-8(a)(2) may be the problem. The Hawaii County Council must, by ordinance, create and designate the speed zone etc. If the signs are just put up at the discretion of the subdivsion and not as directed by County Council ordinance, then they mean nothing.

Yesterday I saw 3 big-ass giant-wheeled ATVs coming up Maku'u going WAY fast. Two of them had toddlers/small children (one looked like she was 2 or 3, the other maybe 4 or 5?) perched in front of the drivers. No helmets, let alone seat belts or doors. Absolutely crazy.
