On the left we got the chick with the snake oil.. and she promises it'll cure all that ails you.. even if she has no idea what kine snakes and all that.. but hey, she's a "researcher" so she's always right, right?

And on the right we have the voice of reason.. ready and able to quote chapter and verse.. and it says here in chapter.. on line.. 

And we all want to know.. will she or won't she? 

Or perchance it just don't matter 'cause nobody gonna vote for one whacked out chic peddling poison no matter?

ARTICLE VI – MEMBERSHIP AND VOTING

Section 1. Types of Membership. There shall be two types of membership:

(a) Members. Lot owners of record of the Hawaiian Paradise Park, Increments I and II, hereinafter referred to as "member" or "membership," shall constitute the Association. The owner of any lot upon acquiring title thereto shall automatically become a member of the Association and shall remain a member thereof until such time as ownership ceases for any reason, at which time membership in the Association shall automatically terminate. Lot owners shall include all individuals and entities (partnerships, corporations, limited liability companies, limited liability partnerships, and trusts) holding legal title as tenants-in-severalty, tenants-in-common, joint tenants, or tenants by the entirety. Lot owners may decline membership in writing only, addressed to the HPPOA office. Former members may rejoin Association membership upon receipt of a written statement sent to the HPPOA office. Lot owners declining membership forfeit all voting rights. All lot owners, regardless of Association membership must pay Road Maintenance Assessments and comply with Association bylaws and policies.

ARTICLE VIII – BOARD OF DIRECTORS
 
Section 1. Number and Qualification. The affairs of the Association shall be governed by a board composed of nine persons, who must be members in good standing. HPPOA employees shall not serve on the board of directors. The directors must be able to attend board and membership meetings in person and serve on committees of the board. They shall serve without compensation or reimbursement of cost incurred as a result of attendance at meetings.

Now, you have stated that the "voting" provision of members versus non-members contained in the published current bylaws of HPPOA to have been overruled by a court order, so, in order to avoid unnecessary delay, lengthy "he said, she said" debate, I think it would not only be very prudent and helpful for you to please post a copy of that purported court order so that the public can see it.

Being a candidate now for the Board of Directors no longer allows you to just respond "do your own research." As a candidate, you now owe it to your constituency to be completely honest, forthcoming and transparent to them.

So, a couple of things Julie, as you do not have all of the info.
1. The HPPOA bylaws have probably been illegally amended at least 8 times, since 1984. There is a court process that HPPOA is supposed to follow and they have not done it.
3. Part of the court process, regarding the bylaws, is that HPP Owners do not have to be members BUT HPP Owners REGARDLESS of if they are members or not, must be allowed to vote (ask why Hoffman allowed those of us who are not members to vote at the last Owners/members meeting). The REASON HPP Owners are allowed to vote is because HPP Owners are "compelled" to pay Restricted Road Fee Money. And the Hawaii Supreme Court ruled it was Utra Vires to force Owners (who were not club members) to pay Road Maintenance Fees and not be allowed to vote.
3. The very definition of "in good standing" is an HPP owner who is current with their Road Fees (not membership dues).
4. As I have stated before, the terms members and Owners, HPPOA and HPP, have been and are frequently and incorrectly switched out for one another. Whether HPPOA and their attorneys did this intentionally (because they wanted to be a "viable community association") or it was just a sloppy mistake, who can say? But Owners were given rights to participate and make decisions in HPPOA governance- the Hawaii Supreme Court said so.

HPPOA's HUGE problem is their Charter. And because their Charter does not address certain particulars (Road Maintenance being one) they have tried, for decades, to correct their short-comings using the bylaws. It is a messy business.

Still, as DEFINED by the HPPOA CHARTER (their words, not mine):

"To foster an atmosphere of cooperation and harmony that encourages the participation of LOT OWNERS in the management and operation of the association."

Lastly, what are you all so worried about? And why do you care? Are you worried the "whacko chick" might actually win?

Don't think so, seeing as the board has been clear that THEY and only THEY are large and in charge of management and operations.

I would like to point out and contradict her incorrect statements but there is no point. She is always right ( at least in her mind).

She is only here because she thinks she has an audience and doesn't accept the fact that most of us don't believe a thing she says.

I am asking YOU the candidate to PROVIDE the requested info. I'm not looking up or asking anyone anything. I am asking you to provide this court order that you claim is in direct conflict with the "illegal bylaws" that are not illegal enough to allow you to quote only one section of but apparently ignore the rest.

First, being that you are a female, I am a bit surprised that you would let the sexist misogynistic pig MyManao call you that. Further, I have never come close to insinuating anything remotely close to thinking you are in any way shape or form "whacko." 

What I want Patricia is for you to WIN. And WIN big.
