update,
NHH took the position of not vacating, until, we could be heard at a Council meeting.

We maintain that there is no justification for Parks & Rec. in denying us our community sport.
There was a prelim meeting scheduled with Roxie (Parks & Rec.).
The meeting was put on hold due to the Leilani eruption and we believed that we we would eventually have our say with the Council.

To our surprise, we once again received a rather curt notice from Parks & Rec.s to vacate.

It was immaterial to Roxie that we were right in the middle of summer programs, youth
classes, weekend races.
Many of our 200 plus members contacted our Rep.s and Chair of Parks & Rec.s committee, J.Ruggles. Our rep.s listened & are supportive
. Na Hoa Holomoku was placed on the agenda for August 7. and yet Parks & Rec. still wanted us to vacate prior to this hearing & resolution.
We have done nothing wrong, contribute to the community and have never requested any monetary contribution from the State or County. We are not asking for a soccer field, a pickle ball court, or a facility to engage in aerobics ( all valid activities).
I doubt we will be meeting their imposed deadline to vacate.
Now, we do have legal representation, do expect to maintain a spot on Hilo Bay validated by an updated Memorandum of Agreement........and while we're asking, we would also like the same privledge enjoyed by our canoe clubs.......access to county water and the ability to safely secure our property.
It is so sad that Parks & Rec. has taken this position with us. We are taxpayers and citizens. I for one do not care at all for the heavy hand in which they have chosen to use.

That’s really disgusting news. I’m sorry that you and your cohort is put in this situation.
It seems clear to me your organization is providing a valuable resource for the community. The only difference I can see between your organization and those not targeted by Parks & Rec. is that your organization doesn’t represent an ethnic or cultural heritage that receives a free pass to violate laws or ordinances in Hawaii because of cultural heritage... “All animals are equal but some animals are more equal than others”

Tom K listed a number of solid complaints against the State and County in the "Ineptness" thread. It's almost to the point that public protests over some issues are in order. Our government officials are too imperious.

Some might consider it a dirty tactic, but some activists target the individual official causing grief, organizing a protest march with people carrying signs with blow-ups of the official's photo with disparaging comments.

About 20 years ago a Parks and Rec official in Waikiki tried to remove all the surf racks next to the police substation. A protest march of some 200 surfers quickly mobilized, sporting such signs about the official who ordered the removal.

The protest generated front page Honolulu Advertiser and TV coverage. The paper editorialized in favor of the surfers. It derided the plan and called the official a "grinch," posting his picture.

I've never seen officials back down on a plan so fast.

Tomorrow is NA HOA HOLOMOKU's meeting before Council members. It has been a battle trying to work something out with Roxie Waljen. We remain quite perplexed at her heavy handed approach to our non profit club.

I'm not sure how many letters of testimony have been forwarded to the office of J. Ruggle, Chair of the Parks & Rec. Committee. Many have also been posted on our Na Hoa Holomoku web site for all members to read. The letters and the amount of them are impressive. We are all grateful for those who took the time to write the Council in support of our program.

In this article Roxie Waltjen was quoted as saying....

“They probably had a verbal contract with the past director,” Waltjen said. However, she said that some boats on the beach do not belong to either UH-Hilo or the Na Hoa Holomoku Yacht Club, but remain on the beach illegally, with some people even operating businesses from their boats."
Not true. All boats on our location belonged to University of Hilo, Na Hoa Holomoku or individual members of Na Hoa Holomoku who share their boats with other members.
NO ONE , in our club is operating a business from their boat.

Several of our Board members did manage a meeting with Roxie Waltjen.
Waltjen started the meeting by passing out copies of the Memorandum of Agreement the State of Hawaii executed with the County , passing to the County ,the management of the portion of State land where our club is located. Waltjen stated that this MOA was for the purpose of canoe clubs only.
Once again....not true. It clearly states Ocean Recreation.

We requested a copy of the existing MOA our County has with our neighbors (Canoe Clubs ).
We were refused . We found it necessary, why we do not know, to file a request thru the freedom of information act.
Something is wrong here.......what and why, is a mystery. Hopefully everything will be exposed tomorrow.

The club did the right thing by filing under the Freedom on Information Act. It is often the only way to get the county (or state) to provide information that contradicts them or conflicts with whatever their hidden agenda of the moment might be. Hold their feet to the fire.

The next trick in their book will be to wait the maximum number of days and tell you the information you seek is confidential. At that point you turn to the Hawaii Office of Information Practices (OIP) and make a complaint. That takes more time... but OIP can instruct the county to provide the information.

Our hearing with the County Council went well. Council members were prepared and treated us fairly. Previous accusations made by the P & R Director against our club were not brought up. No negative testimony was made by any member of the public, just testimony after testimony of support.

The vote was unanimous in favor of Na Hoa Holomoku to receive a Memorandum of Agreement with the County of Hawaii allowing us to continue our activities on Hilo Bay. We have temporarily moved our boats and lockers to adjacent State land while we wait for P & R to perform maintenance of the Bay front.
We are thankful for Council members that brought up our need for security, water and a specialized MOA that works for both parties.
Our Board has submitted what we would like to see with our agreement to our attorneys. They will meet with County Corporate Council to finalize.

This never would have happened in we had not stood up for ourselves and had the support of the community that we received. I hope that the University of Hawaii Sail Club also takes the same course.

I will take this as a good sign that we might be treated in a fair way by Parks and Rec.s .
