I was pointing out that the Supremes struck down Lingle's Act Two, not the Ferry itself...

Note that the emphasis is on the law not the Ferry.
Keep in mind, I was doing so to point to kalakoa's reference to the idea that Lingle could better serve the TMT, asking if another circumventing of our laws is what he was implying.

So in the case of the TMT, who does the law support, the observatory or the protestors? Who is following the law, the TMT or the protestors?

Make a decision. Follow the rule of law. Possibly fight in court over it.
Maybe Lingle would get the TMT built, maybe not -- but either is preferable to wasting $15M to accomplish nothing.

Not enforcing the rule of law: $15M.
Providing actual services (building permits, transfer stations): "not enough staff".

Better (worse) example: Mass Transit (eg, the bus) has a budget of $15.7M, and 75% of the bus fleet is inoperable.
