Actually it's brought up all the time - just today in fact. I don't think anyone called the judges bigots, but perhaps they just used "your honor" as cover. The Constitution of the State of Hawaii Article 12 Section 7. The State reaffirms and shall protect all rights, customarily and traditionally exercised for subsistence, cultural and religious purposes and possessed by ahupua'a tenants who are descendants of native Hawaiians who inhabited the Hawaiian Islands prior to 1778, subject to the right of the State to regulate such rights. All are on DHHL properties. What if a group of Hawaiians wanted to practice their culture and religion in the parking lot? Or protest their lack of a homestead while DHHL caters to big box mainland corporations? Would the citizens of Hilo respond when they couldn’t go shopping? Would the police insure the stores remained open? Or stand around in a non-confrontational manner? Would the needs of the many (shoppers) outweigh the needs of the few? I was wondering the exact same thing, except it wasn't about kalakoa, but the protesters who tried to blackmail Maunakea Observatories today. And if you think that's a strong word, then you should have heard the actual responses from senior observatory staff which couldn't possibly be aired publicly. When you have Kanuha running after an observatory vehicle because he knows his bargaining chip is leaving, you know he realized that he had f*cked up.
