I wonder what might have been accomplished if they were unencumbered by these proceedings. If the Authur's Group prevails and we go into receivership then not much ,if anything, or any resources will go toward fixing the roads. A huge percentage will go just for admin. The 2 sides were supposed to submit 3 names each for potential appointment as Special Master by July 14th. The judge was going to choose one sometime after the 17th. I would expect this to be done in a hearing so that arguments can be made as to conflicts of interest, etc., but I haven't seen anything scheduled. In the meantime all litigation has been stayed to wait for the Special Master's report, so I would expect that the October 30 date for trial will be postponed as well, even though it is still on the calendar. It's possible that you could get more information by going to the court records dept. RE: OLCA lawsuit - dayna - 08-17-2017 I just read this on facebook: "FYI! Nancy Cabral has been appointed by Judge Nakamura to be the Special Master in Civil Case No. 15-1-0238, Barbara Arthurs (plaintiff) vs. Frederic B, Wirick, Ricky Turner, Donald J. Stoner, Tegen A. Greene, Elizabeth M. Wewers, Gerald A. Akana (defendants). Ms. Cabral is to investigate and submit her recommendations by November 15 to Judge Nakamura. It is now much more clear where this is headed, and it doesn't look good for the Wirick (defendant) group. Too bad. For all their other issues, at least they were doing a good job on the roads. This is a tough blow for them. |
