Alleged voter fraud follow up - Rob Tucker - 10-25-2014
Tom Callis, a reporter for the Hawaii Tribune-Herald, wrote in an August 28, 2014 article:
Voter fraud alleged: Police to look into complaint against council candidate
Callis quoted Police Capt. Robert Wagner who:
...said the complaint will be investigated and a report will be sent to prosecutors. “We’ll probably get it done within a month,”
It has been almost two months. What is the status of this police report?

Given County tendency to insist on the most expensive and least efficient solution, the investigation won't be completed in time for the election, thus requiring a separate "special" election, complete with additional court challenges and lots of forum snarking.

TITLE 2. ELECTIONS
19. Election Offense
19-3.5 Voter fraud.
Universal Citation: HI Rev Stat § 19-3.5 (2013)
§19-3.5 Voter fraud. The following persons shall be guilty of a class C felony:
(1) Any person who knowingly registers another person to vote when that person is not entitled to register to vote;
(2) Any person who knowingly votes when the person is not entitled to vote;
(3) Any person who knowingly takes an oath in this title prescribed or authorized by law and willfully makes any false statement of fact while under oath therein; or
(4) Any person who willfully makes a false answer to any question asked of the person while under oath in this title prescribed or authorized by law. [L 1990, c 115, §2]
It looks pretty tough to prove intent. I talked to my Lawyer, Jackie Chiles about this. He said: "That's totally inappropriate. It's lewd, lascivious, salacious, outrageous, egregious, preposterous! "

As has probably been pointed out, "knowingly" implies that TEH was either clever enough to engineer the fraud, or confused enough to do it "by accident", either of which would make her unsuitable for public office in any "real" government.

So confusion is a disqualification here? What about Emily and her gang of tin foil hats?
I'm pretty sure that in the punaweb sphere, Tiffany would lose by 20 or so votes. The rest of the universe will just see the "Not Guilty" or "No charges substantiated"; Or maybe the authorities will try and negate the one vote that Tiffany plotted to use to some political advantage.

(1) I was being "polite" (2) Emily didn't make "vague" residency claims.
One could further speculate: investigation is getting the "well it's just Puna" priority, or (tinfoil hat on) the Powers That Be were hoping for TEH because they're scared of Paleka.
In any case, I'm sure Sativa will ride to the rescue soon.

Kalakoa may be onto something. An effective and competent representative for Puna who is actually able to get along with other council members and get something done is the last thing that the powers that be want. Therefore, I also think that they may be scared of Paleka.

Sometimes you have to light a fire, show the prosecutor and/or journalist there is an interest in the case. If a lot of people start calling, they will be quicker to respond.
I had a case filed with the prosecutors office for 8 months. I called every week, but it wasn't until the defendants were charged with the exact same offense a second time by another party, that the prosecutor started to expedite the case. Then the defendants moved back to the mainland.

961-2385 - Detective Grant Todd is handling the investigation.
He has every appearance of a stand up officer with plenty of smarts, and he's local but from Oahu.
Wilful statement of false fact is stating her residence is the surf shop, on the affidavit, under penalty of law. The affidavit explains that a business address is not allowable. She does not need to know all the complexities of the law. She needs to be able to read the affidavit and understand the term business address. There is a responsibility of a citizen to clarify with election staff if there is a question.
She already admitted in print that she was registered improperly in District 4, in her "setting the record straight piece."
