Act 111 - Rob Tucker - 11-02-2014 Act 111 seems to be Hawaii's version of the Patriot Act. From the Trib in part: "The new law, known as Act 111, is hitting close to home for Puna residents, visitors, businesses and the media striving to report on a slowly unfolding natural disaster the likes of which is not often seen in the United States. Residents closest to the path of the creeping lava are barred from ferrying guests past the roadblocks into their homes. The government is compiling lists of employees at Pahoa Village businesses, who are being issued permits to allow special access should the lava threat become more urgent. Decals or windshield placards are being discussed for residents who need to use roadways into and out of the areas expected to be isolated once the lava flow resumes its slow slither to the sea. Nothing has been finalized, but just the discussion alarms some residents, who say they moved to rural Puna precisely because they don’t want to live in gated communities." And if someone objects to these restrictions on constitutional or other grounds? Act 111 makes that more difficult as well. Instead of going to a judge and asking for an injunction against the government activity, the aggrieved party must make a case before a three-judge panel and a majority of two judges must agree, after giving five days notice to the government. “It is structured like a war tribunal,” said Elaine Dunbar of Lihue, Kauai, objecting to an early version of the bill, “unless it is Martial Law then you should just come out and say that.” - See more at: http://hawaiitribune-herald.com/news/local-news/lava-flow-testing-new-disaster-law#sthash.yMlQujv5.dpuf Text of the bill: http://legiscan.com/HI/text/HB849/id/952669 RE: Act 111 - HereOnThePrimalEdge - 11-02-2014 I pick up anthuriums every Sunday afternoon from one of my growers in the restricted zone. Act 111 will prevent that grower from conducting normal business operations at a time when they need an income and help with their situation. I'm not an employee of their business, but I still need access. Hopefully there will be an understanding police officer or guardsman stationed at the barricade today. RE: Act 111 - kalakoa - 11-02-2014 The good stuff is further down -- and I left out the parts about "can seize/ration commodities". Apparently there's no expiration; all this is for "the duration" (which could be decades, right?) Provide for and require the quarantine or segregation of persons who are affected with or believed to have been exposed to any infectious, communicable, or other disease that is, in the governor's opinion, dangerous to the public health and safety Suspend any law that impedes or tends to impede or be detrimental to the expeditious and efficient execution of, or to conflict with, emergency functions to the extent permitted by or under federal law, suspend electronic media transmission Direct and control the mandatory evacuation of the civilian population Assure the continuity of service by critical infrastructure facilities, both publicly and privately owned, by regulating or, if necessary to the continuation of the service thereof, by taking over and operating the same RE: Act 111 - missydog1 - 11-02-2014 There's so much wrong and alarming here if this gets applied full steam that I won't even start. My question is, the tweets from Mileka Lincoln posted today in the other forum say that residents and non-residents alike will be able to use all the emergency routes, which I think would be the right way to keep commerce and social support structures flowing. What's the real story, if we have one yet? I can't find an article as source for her tweeting. Anyone? RE: Act 111 - Wao nahele kane - 11-02-2014 Content removed by moderator as not Hawaii related. RE: Act 111 - snorkle - 11-03-2014 Since the Militia site you linked was not Hawaii related kane; Are you interested in starting a Militia here in Puna to protect us from the National Guard Troops sent here to confiscate our weapons and imprison us? RE: Act 111 - kalakoa - 11-03-2014 What's the real story, if we have one yet? Good one -- there's no "real story", much less one that will be told to the "little people". RE: Act 111 - Wao nahele kane - 11-03-2014 Snorkle, You're reaching again and it's obvious you're not aware that the Militia already exists in the State of Hawaii as outlined by HRS 121-1. If you're going to comment on something, would you please at the very minimum take the time to educate yourself on the subject before publishing absurd questions? I can assure you, this is Hawaii related and tied to this topic. http://statutes.laws.com/hawaii/volume-03/title-10/chapter-121/hrs-0121-0001-htm |
