Fee Owner - maud gonne - 10-03-2016 Does anyone know what "fee owner" or "fee simple owner" means in property language? I looked up a lot we bought outright a year ago on the county real property tax site and my name was listed as owner, along with another person's name who was listed as "fee owner." We bought outright, have a seemingly clear deed/title, and I'm shocked. I have a request to clarify in with the county dept but am wondering if anyone has knowledge of this. RE: Fee Owner - terracore - 10-03-2016 I just looked at a property that we sold, and have a lien against (because it's an owner finance sale) and the only "fee owners" are the people we sold the property too. Our names don't appear anywhere in the record. I'm not a real estate expert, but it appears that you have a co-owner of the property, at least "on record". I would contact the title company you used immediately. We had one here that made a mistake but they were quick to get it fixed on their dime. RE: Fee Owner - Lee M-S - 10-03-2016 I've always heard that "fee simple" is outright ownership of the land. The other option here is leasehold, where you're renting the land, but may own structures. http://www.hawaiilife.com/articles/2010/07/understanding-fee-simple/ from a realty site Might be a county mistake. That sometimes happens... ><(((*< ... ><(("< ... ><('< ... >o> RE: Fee Owner - opihikao - 10-03-2016 quote:(BBM) Who did your title report? The word "seemingly" concerns me. Clear title/deed is provided upon purchase. Any other reference at the County level, or State level, can be cleared up with your title report you should have received upon purchase. There are those instances where the County is waaaayyyy behind in the records (especially at the Property Tax Office). For example, we had an ohana piece in downtown Hilo which still showed a "Lessee", dated 1940! Seriously, I'm not kidding. Upon the sale of that piece, we had to clear up that manini detail (there was no lease; hadn't been for over 60 years! lol...). If Title Guarantee, or whoever handled your purchase (as the escrow company), they will have on record your closing documents, including your title search, if it was less than seven (7) years ago. If not, I trust your have your set of documents which will enable the County to "clear up" your concerns. Good luck. JMO. P.S. Just thought about it: If you purchased on an Agreement of Sale, or the like, the "Seller/Owner" will not release full title until you have paid the entire purchase price. Well, they shouldn't, as if you default, they get the property back (after a long harangue of legal maneuvering.) FWIW. RE: Fee Owner - punalvr - 10-03-2016 Fee simple= no leased property, or you purchased a long term lease. Fee simple means you own, as you say, your property. When someone else is listed on your title as a fee simple owner, you both own it equally, unless stated in your title. Meaning, who owns the property percentage wise. If you went through title insurance, give them a call. Worst case scenario is that someone sold you his property rights, without disclosing another owner. That could be the reason why there are two owners showing in your title. Did you go through a title insurance company? They will have to pay to get rid of the other owner if they didn't catch him when you purchased your property. Hope this helps. Best of luck. punalvr RE: Fee Owner - Chas - 10-04-2016 quote: Sorry to be off topic. Opihikao, I've seen you use this term before but can't figure out what it means. I even tried looking it up on "netlingo.com". Can you please clue me in? I admit to being "net-illiterate."[ ]Thanks RE: Fee Owner - Carey - 10-04-2016 In engineering, Break Before Make (BBM) is a interruption in a circuit to make a switch, & I have seen BBM used in the technical field to also mean an interruption in an idea flow to switch to another topic... Have also seen it automatically entered on friends who use Blackberry messenger.... RE: Fee Owner - randomq - 10-04-2016 Speaking of tax site inaccuracies, who really owns the HA road lot? http://qpublic9.qpublic.net/hi_hawaii_display.php?county=hi_hawaii&KEY=160130810000 RE: Fee Owner - opihikao - 10-04-2016 quote:Aloha ahiahi, Chas. It means "Bold by me"...(maybe just to me...lol. Not sure of all the internet lingo myself!) have a lovely evening! RE: Fee Owner - maud gonne - 10-04-2016 I'm pretty sure my issue is resolved. First I spoke to the county real property tax dept. They asked me to send a copy of the deed and admitted there could be an error on their part. Then I called the title company who spotted a clerical error right away in the online record (one too many zeroes, or a misplaced zero)which led someone to add a co-owner in error. Title company said they would call the county and point out the error. Thanks everyone for all the advice. |
