Group files lawsuit against FAA - Rob Tucker - 10-01-2018

https://www.hawaiitribune-herald.com/2018/09/30/hawaii-news/we-have-40-years-of-complaints-group-files-lawsuit-against-faa/

“You can look back, we have 40 years of complaints about helicopter noise on the island,” Ernst said. “We tried the administrative, tried legislative, but we got nothing.”

This, I think, is a good example of what needs to be done regarding the CoH and our substandard roads. It will take a Federal lawsuit to have a chance of reversing 50 years of neglect. I will remind our readers that at the time to numerous Puna subdivisions (and HOVE) were approved by the county the county itself ignored and violated existing code for road standards.

Surely tens of thousands of property owners have the wherewithal to fund such an effort.

I would project that if such a suit was filed it would lead to a settlement long before a court judgement. The CoH would not want to lose such a suit. And a settlement could include a share of the FTR (fuel tax revenue) being made available to maintain and improve our lousy roads.

Actually they are working on rules for overflights :

The answer to the lawsuit will be we are working on it.

Any lawsuit against the county of Hawaii for substandard roads would be an increase in taxes or a cut in services. We are the county !

I would contend that providing assistance under the provisions of the FTR would not require an increase in taxes if a settlement is achieved. It may mostly involve gravel. The CoH owns six quarries.

If however a court case involved a judgement such a judgement could bankrupt the county... hence the potential for a settlement.

The problem is to be able get Puna to agree on anything, the people with the tin foil hats seem to have the loudest voice. Federal court is the only place to accomplish anything useful because the state system is kind of small town rigged.
The helicopter suit might bite them in the butt if the plan is made at public hearings

RE: Group files lawsuit against FAA - My 2 cents - 10-01-2018

Wow, did Rob hijack his own thread? Smile

True that it's hard to get people to move in this direction as to the roads. It's the only way, but people would rather fight amongst themselves than fight on the same team. For that reason, if this was ever to come to a settlement situation I would suggest that it included the county taking over the roads but without the requirement to bring them up to "standard". Our associations do nothing but fight, and giving them more money just gives them more to fight about. Taking the maintenance requirement away from the associations and giving it to the county would eliminate the biggest source of association infighting.

Yes, provided that the settlement supercedes County "dedicable standard" rules in favor of gravel, grading, tree-trimming.

The more interesting alternative: forcing County to abide by performance standards and cost controls -- because who needs efficiency when you can just raise taxes?

Seeb, which group would be wearing the tin foil hats at a public meeting about the helicopters?

"Surely tens of thousands of property owners have the wherewithal to fund such an effort. "

What would that take, 4 of the road associations? (Well, 5 because Orchidland has 2).

I bet one (competent) road association could do this. But I'm not sure we have any in the state.
