Real estate fraud? - Seeb - 04-09-2019 I get one of those real estate postcards today advertising a place in HPP it says great investment house with three rentals units. As Far as I know there are no legal multiple dwellings or transferable Ohanas in A1. So are they just outright lying. Or do all those pesky planing rules not apply to real estate agents? Real estate agents are regulated to some extent, but generally can list things that may or may not be true with the proper descriptors: * Potential ocean view! (they don’t have to say it’s from a 3rd story) * Possible subdivision of property! (check with all County, State, and Federal entities) * Handyman’s Special! The agent is simply trying to help the owner sell it." How about because it can lead some unsuspecting potential buyer into a bad mistake? True, it is not the job of a Realtor to disclose . It is the owner's legal responsibility. All fair and good if the prospective buyer knows the questions to ask and does not rely solely on the listing agent's hype. I don't see any lying unless there aren't three rental units. The quote doesn't say three legal rental units... only three rental units. And since anything resembling a roof will be rentable in Puna I don't see the problem. Well, what's wrong with being upfront, complete disclosure?...all parties on the same page...whether we are talking lava zones or building code? I guess I'm of a different mindset (generational?) Dan suggests "report it" and that it all it would take to give the current owner a big nightmare w/ the building dept. Rob says "this is Puna"....yes it is and we are still subject to the same rules and regulations as the rest of the county. Maybe neither of you have witnessed people's dreams & pocket books being smashed by not fully understanding the ramifications of their real estate purchase. I have......and I also would prefer to live in a world where information is not withheld for the almighty dollar. What planning rules are being broken by selling existing dwellings? I don't think it makes sense to hold real estate agents accountable for disclosures on a property they may have only seen once or twice. Where would you draw the line? |
