marijuana decriminalization (a little, maybe) - kalakoa - 05-07-2019

http://www.bigislandvideonews.com/2019/05/07/video-bill-passes-decriminalizing-marijuana-in-hawaii/

Possession of up to 3 grams would be a $130 fine ... if Ige doesn't veto the bill.

Governor David Ige did not say whether or not he will veto the bill as he spoke cautiously with news reporters a few days later.

"I'll be looking at that," Gov. Ige said. "I am concerned, and as I've talked with governors from other states who have gone through recreational, you know, people assume that once it becomes recreational or decriminalized that it's legal. And it's not legal by federal law. And I think that that becomes the confusion, and that's always been my concern.

Maybe someone should tell Ige that all marijuana is illegal under Federal law, no matter how many fees the State can collect for the various permits that they're issuing.

Meanwhile ... Colorado has moved on, they're looking at decriminalizing psilocybin mushrooms.

marijuana is illegal under Federal law

Don’t smoke in front of the HVNP park rangers.

Kalakoa........the Magic mushroom vote was a Denver city ballot initiative.

It went down to defeat.

Good, because psilocybin mushrooms are illegal under Federal law. Who do these cities and states think they are, anyway?

Of course the Constitution hasn't been followed by the courts for over a century...

Of course it has! The trick is to construe anything and everything as "interstate commerce". There was a famous medical marijuana case in California many years ago where the farm (and all its patients) were operating completely within the state with the blessing of the local sheriff. Feds prosecuted on the theory that "well, it affects interstate commerce somehow".

the Magic mushroom vote was a Denver city ballot initiative

It did pass by a narrow margin (50.6% in favor).

Now to see if tomorrow's news includes an official City position about nullification because "Federal law supersedes".

Just read that final tallies allowed It to pass.
Just makes it a very low priority. for the police.

The mayor of Denver just got himself into a runoff. Probably has more important things to worry about.

Personal use/possession of marijuana was made "lowest law enforcement priority" by a majority of Hawaii County voters, whereupon the administration declared the new code null and void due to "conflicts with State and Federal law".

Basically, Hawaii government can choose to ignore the will of the people at its whim, as if "democracy" is just the part where you get to vote.
