That’s the question the county Board of Ethics plans to tackle during its next meeting, with a resolution to investigate whether the ongoing blockade of Maunakea Access Road by protesters is allowed under the county ethics code. The board could, if it agrees to the resolution, call officials to testify on their actions or lack of action.

“Not all citizens of the county are being treated fairly because some citizens are allowed to violate the law and others are not,” said board member Larry Heintz. “They’re not enforcing the law … equally.”

The board rarely initiates its own investigations, instead investigating complaints brought by residents. But it has the authority to do so.

Well.
Somehow I hadn't considered that a County body might look into and review the action or inaction of another County office. Nobody else on the island did either, apparently. With 20/20 hindsight, it's seems obvious that some officials, Harry Kim for starters, must explain how their decisions over the Mauna Kea Access Road are ethical, in line with the law, and how the wants (not needs) of the few have outweighed the needs and tax bill of the many.

I'm certainly going to remember this for future reference, as a precedent.

Here is fun thing we could do. Everyone fill out a complaint form to Hawaii County Planning.Here is the link and it's fillable online :

The parcel ID for the beginning of the Mauna Kea Acess road is
380010210000.Property owner is HAWAIIAN HOME LANDS.
Property address is 38-250 MAUNA KEA ACCESS ROAD.

On the second page you can find types of violations they have to investigate.If we filled out dozens of these complaints and they did nothing it would bolster the case for the ethics commission to go after county officials or not.

From the Planning complaint form:

Construction of any structure without a building permit is a Building Code Violation and should be referred to the Department of Public Works, Hilo Building Division( 961- 8331) or Kailua- Kona Building Division( 323- 4720). This includes people living in tents, buses, shacks, sheds, etc.

There are some structures in the crust bubble caves ( don’t know the real word) the are starting to look pretty permanent.

structures in the crust bubble caves

Caves are explicitly protected under HRS 6D, with most activities requiring "consent of the owner" (whoever that is). Possible that DLNR gets involved here.

Misuse of a cave might also fall under HRS 6E, in which case it's an SHPD matter.

The more the merrier!

Great idea? Yeah right. County will see a batch of fraudulent complaints all come in around the same time all saying pretty much the same, and besides wasting their time what do you really hope to accomplish? Well, other than proving to people here how cool you think you are, what?
