subdivision of a lot - Rose C - 03-11-2007 If a real estate ad says the zoning allows for a possible subdivision, how realistic is this? You need to look deeply into that before you buy if subdividingis important to you. I do know that if there is a mortgage on the property, you can not subdivide it. If you like the property even if you could never subdivide and would be happy with it as it is, then it could be an option. I end up charging just about $1000 as a retainer, the attorney goes from any where from $2500 ret plus $1000 per lot after subdivision. Plus drafting/survey etc........ Look at close to $10-15K just for the paperwork depending on size of subdivision. Then there is the iste work that must go with it (roads, water, etc)... the last time I worked it out for a client - on 150 acres into 5 acre parcels - it was going to be close to $150K (with water and roads). I'm with John, buy the prop only if you would like it even if you dont get to subdivide. One of my considerations was splitting the lot so one of my daughters could possibly build on half of it, the other was to divide it into three separate lots, all fronting the street. The property was sold and the new owners don't want to sub-divide, but if they tried, it wouldn't go through. I also know of some other property which was large enough to be sub-divided and didn't have covenanents against it which wasn't able to be sub-divided because of lack of available infrastructure. The number of houses and the number of parcels don't have to match. If you want your daughter to be able to build a house on half of it, if it is zoned for that many houses, then you can build that many houses. You could own the property with your daughter or just let her build a house on your property and live in it. RE: subdivision of a lot - Kapohocat - 03-12-2007 The big questions is where is it at? I think we can answer more questions that way. What is it zoned now? I see the new parcel size in your post. What is the existing parcel size? If you ahve the TMK # that would be helpful too. And yes the area convenants are very important. Thanks for all your replies. Reading your thoughtful replies did make the rejection of my offer easier to live with. I will try buying a home again once I'm on the island.
