Water storage in setbacks? - toucano - 03-22-2007

Seems like I've seem storage tanks in front or rear setbacks. Is that allowed by code? And are there any restrictions if so?

Its not supposed to be in the setbacks, but you're right, I've seen them there on some houses. If the tank is in the setback it is still legally an encroachment and you could be forced to move it.

And I've heard, but haven't yet verified in the building codes, that the cesspool or septic must be a minimum of 8 feets from any part of the catchment system (like the tank).

It is in the SOH DOH codes, and it is 5' from residence or water system.
