Signs, signs, everywhere there's signs... - Sean - 07-23-2009

So, is it me or am I in the land of the "No Trespassing" signs? As a frequent dog walker I get plenty of time to look around and I noticed a plethora, not of gifts, but of signs. It really makes a neighborhood look, well not so neighborly.

My favorite was the gate adorned with 3 of the same "no trespassing" signs. I can picture a thief thinking, "hey, not that house there's 3 signs!"

Is there a legal opinion somewhere to justify the "stay outs" and "No Trespassing" signs? Hmmmm, maybe it's an insiduous means of identifying transplants by their lack of hostile signage or maybe some folks just don't agree with the lyrics of the song.

Aloha,

Sean

Did you count the ones that say "Kapu?" I don't think it's a local vs. transplant thing so much as a rather ineffective effort to ward off thieves. You see a lot of "Beware of Dog" signs, too. In most states persons who ignore a "no trespassing" sign or refuse to leave when asked can be charged and convicted of a misdemeanor. I do not, however, know the specifics of Hawaii law.

I agree with the strange amount of No Trespassing, Kapu, etc. signs. If one sees a house, is the assumption that it is OK to walk around the property if there are no signs? My favorite is one in Nanawale. It says INFRARED - NO TRESPASSING.

We never use to have signs up, now we have 3 "no trespassing" and 1 "keep out" for the people who can't read. The property is fenced, but we still can't keep the kids out. Kid's in our area are bored, angry and looking for trouble.

Sign or no sign, private property is "KAPU!"

we've put up signs twice since purchasing a lot up at mauna loa estates--older posted signs were already there. a squatter pulled some of them down at least two times. the person wasn't too happy that we had destroyed his campsite and sprayed profanity on the lot and on the signs. think we need to make another visit up there and see if MORE signs need posting.

John,
According to the law, yah, but the reality? Nah....

We had kids screwing around on our land in IL, but if you caught them, they vanished... here? it is more like "Whadda gonna do 'bout it" (I actually had a guy up IN my orange tree last fall give me attitude that he had a right to be there & to pick the fruit.... I hosed him with the watering hose...)

Signs are also good to have if there are concerns about liability issues, not that they hold much legal water, but they are better than no signs..

carey, too bad he didn't make the same mistake as renee and i did thinking that your lemons were oranges. kathy wilson even warned us about them and we didn't believe her. that was a rude awakening!

Posting removes any of the defenses to trespass under Hawaii law. Without signs a trespasser can raise some argument as outlined in law, but with signs all those arguments are moot because of the sign.

So they just remove the sign...."What sign? I didn't see a sign!"
