Kahakai & Woodland Center - Guest - 10-22-2010 Have the good people of Puna been watching the new crash site being completed. The state knowing that this area is the most dangerous intersection in Hawaii went ahead and approved this Loonie Tune construction This is something that I think should be a roadrunner cartoon leaving a power pole right in the middle of the intersection. Between the way too short right turn into Pahoa with the yield sign posted after where you would have needed to see it to know to yield and now this, they seem to almost be trying to create more crashes. My question is, if I do get hit while driving through this mess, who can I sue? RE: Kahakai & Woodland Center - Bob Orts - 10-22-2010 If you can show that the accident was based on a design, engineering, or construction flaw that was or should have been known to exist, you can sue everyone who had a hand in the project. It would be best of someone (preferably a small child, pregnant woman, handicap person, or a senior) was killed or maimed in the accident as that can cause a sympathy effect and get more money for RE: Kahakai & Woodland Center - Kelena - 10-22-2010 It is important that citizens alert the County of the design defect that creates a dangerous condition of property, if they haven't already. Once they are on notice and the crashes start coming, eventually along will come a case where someone is seriously injured. That person --or that person's heirs or guardian-- will be able to prove that the county was on notice of a gross design defect, and that it did nothing about that defect despite that awareness. Immunity yields in an appropriate case. You don't want to be that person and I don't want you to be either. So let's drive carefully out there! It is actually a pretty typical - no different than someone who giggles when some one else gets hurt. It is a transference of the feeling of fear so that you can continue to act. Many EMT's call motorcycle riders "organ donors". I do not think that in any of the posts any one wants someone to be hurt - that they were in effect the worst case scenario for what will happen if this area is left as is. It may not be your response, but do not think for one second that I do not believe this is a dangerous area. LOL and guess who pays, the "tax payers". i know the engineering is looney toons that i agree with, i dont know why you expect something else? oh yeah an awesome park in HPP is next onthe govt list! HAHAHAHAHAHAHAHAHAA why dont you guys get it? the govt is your master and keeper and you love it. |
