HPP leash law ? - hawaiideborah - 06-18-2011 I have a secured fenced lot and walk my dogs on leashes. However, where I live others do not use leashes when walking their dogs. Does HPP have any leash law? I know it is private subdivision, but is there an existing county law to leash your dog when walking on HPP roads? There is no leash required on Shipman property because it is private property. The Shipman owners do not want any vehicles, campers or hunters on their land. The dogs and people are welcome to walk and fish on Shipman land and neither dogs or people have to be leashed. Thank you for any information. RE: HPP leash law ? - Kapohocat - 06-18-2011 We having been checking this out here in our subdivision too and with the MLCD practically in the subdivision's back yard. There is no state wide lease law. Chapter 4 from HCC: http://www.co.hawaii.hi.us/countycode/chapter04.pdf Article 1 ® ® “Stray” means: (1) An unlicensed dog or dog without a license for the current year; (2) Any dog on the premises of a person other than the owner of the dog, without the consent of an occupant of such premises; (3) Any dog on a public street, on public or private school grounds, or in any other public place, except when under the control of the owner by leash, cord, chain or other similar means of physical restraint, provided that such leash, cord, chain, or other means is not more than eight feet in length, and provided further that this provision shall not be construed to permit that which is prohibited by any other law; Section 4-29. Leash required for public places. No person shall bring or permit any dog in any County park, public school ground, or airport unless it is held under control by a suitable leash, not more than six feet long; provided, however, that dogs even under control by a suitable leash shall not be allowed in any County beach park. These restrictions shall not apply to dogs utilized by police for patrol or other police purposes. (1980, Ord. No. 510, sec. 2; Am. 1986, Ord. No. 86-34, sec. 5.) Chapter 10: Leashed or lead control means a suitable restraint no longer than twenty (20) feet in length and in good repair which is affixed to the collar, halter or harness of an animal and is held or controlled by a person capable of exercising adequate control over the animal. Dogs on public property are required to be under restraint, that is, on a leash of eight feet or less. This includes beaches and parks, except for those specifically designated as off-leash parks. Seems like you have done lots of work to find out the answer. the quotes from your post sure do lead to confusion. (meaning the sources don't agree, not you) Seems like you have really tried to make sense of this. seems like there is a 6 ft. and 8 ft. and 20 ft. leash length. Hard to determine for the average person if a dog needs to be on a leash on a road in HPP. (This is reminding me of the discussion and confusion about access to the cliff/shoreline in front of the homes in HPP. I never did get clear on that one and have re-read the thread several times...) seems like there is no clear agreement on leash requirements. Just wanted to know if I had any leg to stand on with the folks who have their dogs out walking in HPP without leashes on. Seems like I really don't. so I will continue to not say anything. Divided into 'little dogs' and 'bigger dogs' areas, it is completely fenced with a sally port so no escapes occur. For whatever reason, it is hardly ever occupied when I and Mele go there. The roads in Vacationland are private and I don't believe VHCA which controls the private roads has granted permission to dog owners to allow their dogs to defile the streets. The same would apply to HPP. Section 4-19. Defecation and nuisance prohibited. (a) No person who owns, harbors, keeps or has charge or control of any dog or other small domesticated animal shall cause, suffer, or allow such animal to soil, defile, defecate on, or commit any nuisance on any part of any street, including any sidewalk, passageway or bypath, or on any play area, park, or place where people congregate or walk, or on any public property, or on any private property, without the permission of the owner of the property. Note also that it reads that an owner is not allowed to let their animal "commit any nuisance on any part of any street".If a dog is running off leash and chasing people or dogs that are on leash ,it is creating a nuisance. Manager of Shipman Properties told me all paths are open to walkers, not just shoreline. Yes, the nene are there. Around the actual landscaped estate no public allowed. this includes the nene sanctuary. In addition, it is clearly posted that no dogs and no people are allowed in the nene area. So your concerns about dogs getting there are addressed by the estate signs right along the landscaped estate area. In front of this compound area is the beach where dogs are allowed but sign requests that dogs be leashed on the beach and not venture onto the lawn property. I go there often and it is no problem with others who have dogs. As far as I can tell everyone has respected keeping their dogs away from nene land. There are nenes throughout the area and they have reported nenes killed by dogs. Unleashed dogs found are requested to be lessened by their security and have been taken to the pound if not. My understanding is that onl the public path is open to the public. |
