Sunshine Law and Legislative Practices
This bill would require the Legislature to adhere to fundamental principles of the Sunshine Law. Within this bill, our Legislature would be required to give a seventy-two hour public notice for public hearings, and would also be required to consider correspondence on measures to be considered testimony.

SB 220
Disclosure Deadlin
This bill would mandate elected officials to submit a financial disclosure form by January 31 (at the start of legislative session) instead of its current required filing deadline: May, after session is over.

SB 832
Lobbyist Regulation
This bill would require lobbyists and their clients to make monthly disclosures during legislative session, in addition to filing a report for June 1 through December 31. The "Lobbyist Regulation bill" would also require lobbyists to disclose more specific elements, such as: lobbying activities, contractual relationships with legislators, and any of their campaign contributions.

These bills call for the strengthening of financial disclosures and record/testimony-keeping. In turn, they will help to create a more transparent and accessible government, so that we can continue to hold our elected leaders accountable.

"Impeach Hawaii's Governor? State Senate Establishes Causes

CB: Senate Bill 229 would spell out possible causes for impeachment of a governor, lieutenant governor and appointed officers.

SB 229 passed Senate Judiciary and Labor on Thursday and now awaits a floor vote and likely crossover to the House of Representatives for consideration….

Article III, section 19 of the Hawaii State Constitution addresses impeachment but says very little….

Under the proposed legislation, the causes of possible impeachment would be as follows:

• treason, bribery, or other high crimes and misdemeanors;
• misfeasance, malfeasance, or nonfeasance; or
• moral turpitude

The Hawaii chief justice would preside over any trials, and a two-thirds Senate vote would be required for conviction….

"Upcoming Event: The PLDC and Property Rights in Hawaii

On Tuesday, February 26, 2013 from 7:15 - 8:30 p.m., the University of Hawaii Law School is sponsoring a talk about "The PLDC and Property Rights in Hawaii," which will feature our Damon Key colleague Mark M. Murakami.

PLDC refers to the Public Land Development Corporation, a state agency created in 2011 to develop state-owned lands, primarily in concert with private entities. As Honolulu Civil Beat's information page on PLDC notes:

The corporation has broad powers for entering into private partnerships and establishing its own governing objectives and policies. It also is tasked with identifying state lands under DLNR that are suitable for development. The Board of Land and Natural Resources must approve all land transfers.
The corporation, with the approval of the governor, can also issue revenue bonds for constructing, acquiring and renovating public facilities, as well as for the acquisition of non-public lands.

Since its formation, the PLDC has become highly controversial, and the Hawaii Senate recently voted to repeal it. We moderated a panel on the issue at the Hawaii Land Use Conference in January, so the U.H. program will be a good update.

The panel will discuss three issues: the different perspectives on the PLDC issue itself, how the controversy over the PLDC reflects the tensions underlying the property rights regime in Hawaii, and (in an unrelated but pressing subject for law students) the speakers' views on how to thrive in law school and the legal job opportunities after graduation.

Joining Mark on the panel are Professor Shelley Saxer (Pepperdine); Marti Townsend, Executive Director of the Outdoor Circle; and a panelist to be named later (perhaps a legislator involved in the issue). Stay tuned here for a follow up.

Here is the actual addition to the current reg that is proposed in SB1027:

Adds a new section to part II of chapter 205A, Hawaii Revised Statutes, to provide a process for state consistency review and certification for development by a state agency on state land within the special management area.

I am not commenting on good or bad on this one. It could go either way. It could be used to develop a state campground on state land say near Kapoho Beach Lots or it could be used to lease land to a big resort development company on state land... hard telling...
