Howard probably meant to say "trademarked." "Punatic" has not been trademarked yet. Given its long use, it is unlikely that a trademark would be given, and if given could be defended successfully in court.

I'm not a lawyer but we have an intellectual property lawyer on retainer for our business and have learned a thing or two about the topic.
