“In my time trying to locate the county surveyor, in speaking with multiple county officials, everyone of them told me HPPOA roads are private and the county has no authority or control over them. They all told me I should discuss the matter directly with HPPOA.”
This is correct. The roads are OUTSIDE of your property line. The county, and not HPPOA has jurisdiction over what you do INSIDE of your property lines.
HPPOA has absolutely no authority over anything you do within your property lines, including setbacks. Nothing, period.

There is no such thing. HPPOA is claiming that they have this authority. It is up to them to provide proof of that authority. The only “proof” that they can provide will be documents fabricated by them. There is no statute or case law that supports this. I suppose it’s possible that you signed an agreement with them when you bought your property. If so, then that’s on you. However, if you were told that you couldn’t purchase the property without signing that agreement, well, they have no foundation for this to be a requirement.
This all falls into the category of Deceptive Trade Practices, which is a class C felony. When you ask them to provide their proof you should be sure to require a signature of the person or persons who are willing to stick their necks out. They probably will because fighting them in court means you spend your money on it and they also spend your money on it.
Yes, it gets sticky and complicated. Most folks will just roll over and comply, so it continues. I’m just giving the information, I’m not telling anyone what they should or shouldn’t do.
My apologies if this turns into another dreaded HPP thread. I think I’ve said my piece, and I hope I’m done.
Yeah, wasted time.
