Zoning enforcement stance - Planning Dept.
#1
Okay folks, We have talked at some length about the need and lack of enforcement of zoning code by the county. With Chris Yuen giving testimony to the council about the Athena's Huli Chicken and Filipino store on Hwy 130 and with a history of this non-conforming site
being brought to the attention of the Planning Dept. I got this response from Larry Brown on the subject today:

Rob,

For this type of alleged violation we are still requiring a written complaint. Our complaint form can be downloaded at http://www.co.hawaii.hi.us/forms/planforms.html. I spoke with out East Hawaii Zoning Inspector, Robert Usagawa, to confirm whether or not he has either been instructed by the Planning Director to investigate Athena's or if he has an existing complaint. He responded in the negative to both. Robert (Moose) further informed me that alleged land use violation complaints that don't appear to present an exceptionally hazardous condition to the public or environment or an unreasonable nuisance are investigated in their order of receipt. We are still investigating these types of complaints that were received in 2003, so it may be a while before a complaint against Athena's is actually investigated.

Larry

Assume the best and ask questions.
