I guess it doesn't surprise me because it happened to my sister. Her hubby, father to her 5 kids left her and moved in 3 doors down on the same block and married the neighbor and lived there for years. It's not like Rick had anywhere to go anyway, he's not rich, in fact he's still working, for the subdivision. I also understand the victim had told his wife he wanted her gone when he got back from a mainland trip. He got his wish.

Sure folks have the right to choose who they want to be with but when they deny the powerful emotions that go along with a relationship and the other set of powerful emotions that come with a break up is either icy cold or it's very foolish or both. We are not just intellectual beings we are literally educated animals motivated by hormones and emotions as much if not more than our intellect. Lou Rawls sings it the best: "What you won't do, you'll do for love".

I've been in Puna most of my life and this is a small gene pool. When I break up with someone I let them tell me when I can start dating again. I say if it takes you a year to get over it that's fine I don't care. Because it takes time to get tangled up with someone and it also takes time to detangle.

What's to be prosecuted for? Self defense, unless I missed something. BTW, death by blunt-weapon trauma is one of, if not the leading cause of wrongful death in the USA.

Blunt weapons like, say.... baseball bats!!!

Coming at someone with a baseball bat sounds like an imminent threat to life that resulted in justifiable homicide. Of course, there are legal pundits in Hawaii who will say that the guy should have taken the time to find a baseball bat of his own so it would have been an even fight.

There is a backstory here, those two had been at it for months and nobody had ever called the cops, no tro, nothing. Rick had said months earlier he would "bury that M. F. In my front yard". The bat was for smashing the windows in Ricks Mercedes, which had been done a couple of times.

After months of disagreements, my neighbor charged me with a knife. I retreated and called 911. The responding officers confirmed that I would have had to retreat to the point of being trapped before I would have been legally allowed to retaliate.
