"The treasurer and VP have attempted the ousting of 2 finance committee members who were voted on by the membership back in July 2015. They have requested financial information and never gotten it. They are also denying 2 new members a seat on the FC that was voted on by the membership at the Oct 2015 meeting to fill the 2 vacant FC seats, and are not recognizing them as members. The VP and treasurer have instead brought in another member, their pick, in order to get their majority voting power. The vacant seats were already filled by the 2 voted in Oct 2015, so their adding another member isn't legal."

You should really get someone to read the bylaws to you and then explain them !
The bylaws don't allow the membership to add committee members at that meeting.

I could go on but I don't live there and if I did I would be ashamed of people posting gossip on a public site.

What was it caveat emptor said the last time Obie came to this thread to take jabs? Oh yeah, don't talk to strangers in their underwear.

The First Amendment protects us from government interference with speech based on content, with notable exceptions such as revealing classified secrets, yelling fire in a crowded theater and libel or slander. It does not mean that privately owned media such as a newspaper or internet forum have to provide a platform for speech to all, it also does not protect anyone from the opinions or responses of others who read or listen to that speech. So the First Amendment doesn't really come into play in this situation. Obie can post whatever Rob allows him to and people who are offended by his comments can respond as far as Rob allows too.

Obie is going to be my neighbor, I know who he is, but he has no clue who I am, so it will be interesting to see how he behaves in person. Friends who live in Kapoho say he is only slightly less abrasive in person, but the Kapoho place was just too good a deal to pass up and I am a good 35+/- years younger, so I figure I will just outlive him and enjoy the neighborhood for another 50 years or so. Can't say I am going to miss the daily drive into Hilo, I am looking forward to telecommuting all but 2 days a month when I will have meetings and working from my lanai the rest of the time.

Everything Mermaid has stated in her last two posts is excellent and right on. I also agree with Reni here. I am sure Kalakoa and Obie will have some comments about that. Yes I have tangled with Mermaid when she was defending the treasurer and wanted to give the board a chance but things change and the truth about what is going on with the VP and the Treasurer is undeniable. What shocks me to no end is that the rest of the board we have now either doesn't understand the by-laws and state statutes, hasn't tried to and/or has totally been snowed by these two law breakers. They do not seem to discern right from wrong and are weak and will not stand up to them. It would be a cinch to vote the two off instead of setting themselves up to be involved in a lawsuit. The president has done nothing to lead. It is crazy and they hold our money hostage while we have to come up with thousands if we want to fight. It is apparent to me that these two likely have a history of lawlessness and know that the system is on their side. If we could only know of their history we might be enlightened. I did hear that the VP has tried to sue before. Any way, I am hoping that enough HPP residents will get together and donate to a collection for legal fees. We can't give up. i am sure that they want us to get worn out and just walk away while they run amuck.

I'm pretty sure I know who you are because I just sent you a friend request on Facebook !

Welcome to the neighborhood ,just remember those of us who live here built this neighborhood into what you see today!

We bought the ice houses, remodeled them and turned them into vacation rentals. We have paved streets,a water association that supplies county water and we have a Neighborhood Watch that is used as a model !

When I say we, I mean everyone who has participated !

Obie, happy new year to you.
I am glad you enjoy sunny kapoho and have made it your neighborhood. I lived kapoho in the 80's and again in the mid 90's, absolutely loved it. Farm lots were selling inexpensively for less than $25,000, houses near the ocean were selling for less than $100,000 regularly. If you ask a rambler like myself about kapoho these days? I would say The old times in kapoho were a much more relaxed, friendly, and fun way of living in paradise. Than The often tourists used, abused, uptight, restricted, and expensive kapoho it has become today, jmo.

Obie, You and I have a lot in common after all. I may not have been part of your neighborhood watch program (sorry holiday inn's not my style). I did vote for your county water, helped plant hundreds of trees, even helped build a few homes or extra large rock walls throughout kapoho. I guess you could say with my blood, sweat, and tears and ofcourse your mainland retirement money. We have helped make kapoho and what use to be the red road what it is today, A place on most visitors maps.

Ho hum......... Gypsy and Obie; start a Kapoho thread so you can talk to each other about how wonderful it is there. This is about HPP and some of us are trying to dig a way out of the mess just a handful of people created. Sorry to hear that you will be leaving us Shockwaverider. You seemed to be a voice of reason here. 1 more sane person gone that could help the good ones. I said it before, it is unfathomable that the entire board has been bamboozled by the VP and treasurer. They are now aiding in breaking Hawaii state law.

I'm sure the State will get right on this. Problem solved!

I just heard from some one on the finance committee (that is the real one) that they met this morning and went into the office to collect the financial reports including the audit. They were told by Don Morris, the GM, that Craig Crelly, the president of the Board told him not to give the financial reports to the members.
So, now we have, if Don wasn't lying that it was really the VP, the President of the board telling an employee to not just break our bylaws but break state law as stated in HRS 414D. Is he really that stupid to put himself in legal jeopardy?
