Can't we at least focus the lawsuits in the proper direction?

Isn't this going to cost the association a lot of money? I guess the general manager thinks it's worth dragging HPP through the mud over. Obie isn't the general manager a friend of yours? Do you know if the director was served before the article came out? If not, what a way to learn about it.

What if there are no lies? Then it's not "untrue and defamatory" right?

I don't know the details of HPP business but the way it SHOULD work out is that the Director should be covered by D&O insurance. It would likely have a rather large deductible but that should be the extent of the financial cost to the association. As plaintiff the GM would be financing that side personally with little chance of recovering anything without a victory or at least a solid, indisputable case. Money to burn?

leo... The director had no idea about the lawsuit until someone called her about the Tribune article. She hasn't been served yet.

Yeah,I started a new topic and moved my original post, which was a link to the newspaper article.No one posted anything there and continued posting here. So I was able to delete it. The only post was mine.

There are at least three sides to this already, the sue-er, the sue-ie and the hppoa Corporation. If hppoa can prove that whatever the sue-ie did was outside the scope of he/she’s job it could get the association off the hook

Those statements include, according to the filing: "The GM was playing a shell game with expenditure accounts of the financial reports"; "Fact, there has never been a real accounting of the expenditures with documentation …"; "We have already got evidence that the GM has no problem in hiring questionable vendors, skirting regulations …"; "allowing the GM to spend $1,500.00 per day with no oversight is criminal"; and "I sincerely believe that at best the project was mismanaged and at worst includes misappropriation."

Striking similarities to the allegations made in these very forums! I'm sure it's just a coincidence, and I look forward to DISCOVERY.

Even if my enthusiasm is misplaced: I consider HPP to be an accurate microcosm of "the County Way", and think these efforts would be better focused on the "faux residential" problem...

Seeb is probably right about the association. Directors and officers liability insurance typically only covers acts done as part of the official duties of the person being sued. The insurance carrier may view the alleged defamation as being personal and not official in nature, particularly if the act or acts in question took place outside the usual HPP venues.

In case some of you don't know what we're talking about, here is the link to the local newspaper's report that the General Manager of HPP is suing a board member:

Meanwhile, my road is in better shape than it's been for years, and that's after five inches of rain. I hope all this doesn't distract the workers from what appears to be much improved performance.

It seemed like a good idea when kalakoa mentioned it.
