RE: TMT - Contested Case Hearing Status - Hilo - HereOnThePrimalEdge - 08-05-2016

the original six petitioners renewed a protest over Amano’s selection, claiming the state entered its contract with her prior to hearing objections.

And then if the merits of that protest are investigated (tick tock, tick tock), after the finding who knows how many other objections may be presented? Perhaps protestors had no time to object to the proceedure potential judges should follow to become qualified, or the number of judges who would be seated (why not three?), or where the case should take place (how about on Mauna Kea?) etc etc etc.

You don't have to squint to find as many carts before horses as is necessary to create infinite delays:

“It was ‘the cart before the horse’ all over again and the Petitioners did not have an opportunity to be heard at a meaningful time and in a meaningful manner,” wrote attorney Richard Wurdeman

The moon kind of surprises me sometimes. I’ll be out at night and I’ll see a nice moon, and say, “Hey, that looks good.” Then I’ll say, “Oh sh-t, I went up there one time!” Kind of surprises me. It’s like there are two Moons, you know—the one that’s usually around, and then that one. - Michael Collins, Apollo 11 astronaut

create infinite delays

"Gee, I wonder why these projects always take 2x longer and cost 3x the estimate?"

This is the most detailed information I've been able to find regarding Friday's latest contested case hearing:

http://www.hawaiitribune-herald.com/news/local-news/amano-tackles-tmt-motions

The judge threw out motions, others remain and everything as clear as mud. With scientific pressure increasing on the TMT to become operational while the JWST is working plus pressure from TMT's partners regarding funding, I'll say again I don't think the TMT will be built here no matter the result of the hearing.

PS. As Opihikao mentioned earlier (thank you!), the written motions are available here (scroll down to the "DOCUMENTS LIBRARY" menu):

176 documents so far and sure to grow.

The Canary Islands would be a nice home for this TMT Telescope because it would be in the Northern Hemisphere while also being closer to Home.

Judge Amano has her hands full with this one. Doesn't appear to be an open-shut case by any means, so I would expect this case to take plenty of our Hawaiian time.

P.S. The Canary Islands may not have the serious light pollution problem you speak of TomK. They have limited most of the Island "residents" use of light much like Hilo and Puna has as to respect the prestigious astronomy communities work atop their Mountains. Mauna Kea and it's people are being used, abused, and held hostage by the Astronomy community from afar. The Truths about this TMT raced project and respect to our island people is long over due. jmo

Thanks for your scientific analysis, Gypsy. However, the Canary Islands have a light pollution issue which would affect TMT's optical performance, and is a poor infrared site, which would, well, you get it.

As to being closer to home, what do you mean, and what does this have to do with the contested case hearing?

Gypsy wasn't courageous enough to actually answer my post, instead edited his own post after someone responded to it.

What has this got to do with the contested case hearing and can you provide any evidence to back up your claims?

Aloha kakahiaka all. FYI, update: (*Snipped - More at link incl. video)

http://www.bigislandvideonews.com/2016/08/06/video-tmt-contested-case-request-for-continuance-denied/

Mauna Kea Anaina Hou’s request for continuance on submissions was denied during a pre-hearing conference for the Thirty Meter Telescope contested case in Hilo on Friday.

Hearing officer Judge Riki May Amano said no good cause has been set forth to push the hearing back to August 19.

Additionally, Judge Amano has set a site inspection for all parties next month, and intends to start the hearing in October.

TMT officials also say Amano scheduled a site visit for next month. Parties on both sides of the issue will go to the Mauna Kea summit to survey the proposed project site.

On Friday, Amano heard a number of motions on the controversy, including one challenging her selection.

It's her first hearing since June when she increased from seven to 25, the number of individuals and groups taking part in the process. The issue remains heated.

Anyone else notice how the news coverage mentions that TMT would now like to break ground by "April 2018"?

Previous reports stated "need permits by September 2016 to start construction in the spring".
