No we are not bankrupt. However, violations of the bond indenture agreement could result in a call that could push HPP into receivership. I hope the bond holder is paying attention to what’s going on right now.

I have talked to people who were HPP owners during the 90's receivership, and they all report well maintained roads, stable fees, and a lack of bickering. Of course, all good things must end, and the judge decided to return HPP to "democracy." We all know how that turned out.

The whole framework is broken, and no amount of trying to enforce the current (or any future) bylaws is going to produce a long term solution. I suggest receivership to install outside professional management followed by monitoring through a governing body of non-residents appointed by the senior judges of the Hilo Circuit Court.

Maybe the receivership is just a guise to get District 5 and 7 directors off the board? From what I gather they aim to judicially remove them but keep Kaawauhu and Creeley. Creeley resigned so how does that work? They aim to keep the general manager Don Morris employed by HPP. They want to appoint new board maybe bring back directors who just resigned? Maybe other recycled cronies too who love the general manager? Same peeps who don't want a forensic audit. How's that a good move for HPP? I heard the new directors are all new people and are legit. Only thing is three people managing HPP won't concede. They hold the purse strings. That is the crux of it all. This whole thing looks like it was planned by the five directors that resigned. At least in Orchidland, the board held the purse strings. Who's signing the checks?

Chuckster, I agree with what you say here. And this is precisely what I am afraid of.
We spend $300k-$400k only to be returned to the same situation a few years later.

I had heard that a few of the new people , who had stepped up to volunteer on the Board were in favor of Professional Property Management. I had hoped that we could have at least tried this approach first. Maybe with professional oversight, we could have attracted those, who would never even consider wasting their time on what we have now.
Not to mention the liability of such "service".
It is not so much that the framework is broken, but maybe we have reached a tipping point in our society where talented, capable , experienced people are no longer willing to serve on neighborhood boards.

Well, this could be a workable solution . How do we get there from here?

No doubt the behavior of certain Board members have brought us to this point.
Although Receivership is not yet the certain outcome, there are those obviously
pushing, one could even say orchestrating current events to push us to the edge of receivership.

However, I doubt very seriously that their ultimate goal .would be for outside professional management
followed by monitoring through a governing body of non-residents appointed by the senior judges of the Hilo Circuit Court.

Reni - I agree that the goal of the latest lawsuit seeking receivership is not to replace the current management with outside professionals. It looks to me like a way to preserve the status quo without having certain "bothersome" board members to deal with. We can only hope that the law of unintended consequences kicks in and a complete overhaul is the result.

AMEN........and there are other owners, not party to the current legal actions that are fed up and are willing to push for the unintended consequences....ENOUGH

dan, my guess is you support the lawsuit and the directors who instigated it? Is it ok that it comes at a price tag in the thousands? Who's signing HPP business checks if Kawaahu blocked the new board?? A board of one spells trouble and a general manager without any oversight? Figure it out dan.

The HPP charter requires a board of at least three.
