I would hope by tomorrow morning, the proper documents will be filed advising change of counsel of record. Want to add comment, however, need to think this through, as it is fresh information. Not to mention, the repercussions here on PW when commenting on "hot topics". Rumors, assumptions, and innuendo are useless at this point. The facts of the hearing, including this new development, will be forthcoming on record. How this affects the timing of the hearing, if at all, is of concern. Have a lovely evening all. JMO. Due Process means you get an opportunity to be heard. It doesn't mean that the opportunity is exactly when you want it to be, or for the length of time you want it to be, or that the result has to be what you want it to be. I've had trials where hundreds of millions of dollars were at stake and the trial was set for four days. Four! Could my team make every argument we wanted to? Of course not. But the Courts are full of cases, the Judges have limited time, and everyone thinks their case is most important. Given how long this story has now been in the news (over a year now), everyone *should* have their act together and know their arguments cold. I can appreciate folks thinking they aren't getting enough time or opportunity, but from everything I've read, they are getting their "due." According to that statement, counsel has scheduling conflicts and chooses to appear at his other appointments rather than represent clients at the TMT hearings? It could be emergency surgery that can't be rescheduled with his doctor, but short of that and considering the significance of this case, why aren't the other appointments rescheduled? If there's a choice that can reasonably be made?
