I know interns that worked up there through the PIPES program for science.

The dishonesty in the extreme spectrum of arguments made against the TMT only hurt their credibility. I can understand it if they had specific religious objections, but the distortions and over dramatics make them very hard to take seriously.

RE: TMT - Contested Case Hearing Status - Hilo - MarkP - 01-30-2017

Exactly Eric. There is a wild array of technical arguments against the TMT, none of which hold water. When you push back against those arguments you get "Well, it's not about the TMT. It's about Native Hawaiian culture". Smacks of grandpa's stories of having to walk 10 miles to school through the snow, uphill, both ways......

This is just bizarre, not sure I've seen something like this before:

January 30th, 2017, part 2. The relevant part starts at minute 71:00.

Fergerstrom is cross-examining a witness who is on his side, starts to testify himself, and not only his own witness objects, other parties on his own side object. If it weren't so serious, you might even be able to giggle a bit.

At some point they need to just shut this down. Most murder trials would not have gotten this much court time. Does anyone at this point NOT understand the various issues are? Make the ruling, get the appeal paperwork on file, and everyone get on with their lives.

RE: TMT - Contested Case Hearing Status - Hilo - MarkP - 02-01-2017

Fergerstrom aggressively rebukes Amano for doing what I consider to be her job, preventing him from rambling on and killing time if he had no further questions. Somebody else gets up and points out how ridiculous things are getting and that people have to be at work tomorrow at which point he capitulates. Are there any rules to this circus? Does a hearings officer really have any authority? Are there really any consequences for grandstanding and outright aggression?

RE: TMT - Contested Case Hearing Status - Hilo - kalakoa - 02-01-2017

Are there any rules to this circus?

Yes, we're follwing them right now. Diligently.

Are there really any consequences

No consequences in Hawaii County.

RE: TMT - Contested Case Hearing Status - Hilo - HereOnThePrimalEdge - 02-01-2017

Are there any rules to this circus?

One of the arguments I've heard in the past is that the DNLR and State of Hawaii have not strictly followed their own rules, and that's what got us into this mess in the first place.

Well, here we are. Let's watch video of the people who argue that particular point, the petitioners who contend we must adhere to the rules and regulations set down by the governing bodies of Mauna Kea summit. They assert that should the TMT observatory not comply with every rule, deadline, and hearing procedure, construction should be suspended, permanently.

What if we extend the petitioners' argument to the petitioners? Should courtroom procedure not be followed, to the letter, their testimony is immediately halted, blocked, stopped, they are asked to leave, and not "permitted" to return.
