Gays married legally elsewhere moving to Puna - hawaiideborah - 06-26-2013 When legally married gay couples who can receive all the Federal benefits move to Hawaii do they lose the Federal benefits they have? What about retired military currently married and living in Washington State. They retire and move to Puna... Do the Federal benefits (healthcare, spousal pension) stop because they are no longer in a state where gay marriage is legal? Whats the difference? Sounds the same to me! So your saying the Supreme court decision doesn't affect Hawaii? I'm confused... That said, media coverage clearly indicates that Federal benefits are extended to same-sex couples whose marriage is recognized by their State, meaning you must be married and reside in a same-sex-marriage state (not necessarily the same one). Civil unions or domestic partnerships are not considered "marriage" for the purpose of establishing Federal benefits. Importing benefits by means of a smoke-and-mirrors "residency" claim may work, but now you need a lawyer and a tax attorney, and you better keep excellent records which clearly demonstrate your "residency" (or lack thereof) to both states.
