Kenney, I couldn't have said it better myself. James, I know you were around because we all know your wife was on the board in the very recent past.

These mismanagement actions Kenney speaks of occurred throughout the tenure of the terminated employees so includes other board members beyond the previous board. Read the BoD Minutes starting around 2009-2010 with the employee conflict of interest topic and go forward in time. See who the repeat board members are. How does an employee trucking conflict of interest disappear off the agenda so it can continue? Why did we keep using the same road material vendor despite the DOH fugitive dust complaint and all the irate owner complaints over the past 3-4 years. Why wouldn't you just change the vendor to get a better product instead of watering the roads in the heat of the day which means the water evaporates in minutes. It was a costly remedy to our association.

From Dec 2013 until June 2014 was an especially stressful time with all the blunders from the previous management and majority board which cost us a loss of thousands and thousands of dollars.

Phanor, why don't you go study the Minutes (although edited or at times coincidentally missing ) and see if you still think you want to stand up for the terminated employees.

Phanor, you and your husband have done a great disservice for all of the HPP lot owners by inciting fear out in public. The previous JC group did a similar thing advertising in the paper to incite owners before the Special Membership Meeting called by JC group including few HPP NW people, one of them who helped script the petition. Are you part of this same group?

Inciting fear and anger in public harms HPP's reputation and property values. Nothing good comes out of it.

The apologists for the current board are consistent:

1. personal attacks on those who challenge that board.
2. claims that alleged actions by others were wrong so the wrongful actions by this board are to be ignored.

Proving that this board's actions are indefensible.

About my "membership". Correct, my name is not on a deed.
Never said it was.
Of course, neither would these names be on any deed: "Orchidlandguy", "mermaid53", "karma96749", etc.

Count 1. Unlawful discharge – violation of Hawaii Domestic Nonprofit Corporations Act (HRS 414D-149) and association governing documents.
Count 2. Unlawful Discharge – whistleblower. Regarding terminated employees, just before being terminated, informing DOH that HPPOA President had ordered ceasing dust mitigation actions.
Count 3. Defamation. Regarding public statements made regarding job performance of terminated employees.
Count 4. False light. Deceitful claims by defendants regarding storage of non-operational HPPOA equipment.

Now you're grasping for straws making personal attacks and spreading misinformation regarding deeds. I've not posted anything about your name being on your deed or not.

Now that you've told us all that your name isn't on a deed for property in HPP, that reveals you're not an association member. This means you can't speak during owner input at any HPP meetings again, much less yelling from the gallery which then you can be escorted out immediately as a non member. I believe your comments about association business as a non member are supposed to be disregarded.

Your group, as evident with your posting and others you know, are the ones who started the personal attacks to even non board members without provocation. Your group is the one who consistently challenges the board at board and general meetings in a disruptive and disrespectful way. Your group is also disrespecting innocent lot owners who've taken their time to attend meetings to get informed and can't. This has caused a very negative atmosphere for all of us.

Your group has taken your actions to a whole other level that is mean and vindictive in the name of supporting your terminated employee friends. What does this say about the character of the terminated employees who must be supporting your group's bad behavior to include disrespect towards other association members? You guys need to get a grip and stop this nonsense. This dispute is between them and some of the new board. Leave it up to them to duke it out and stop ruining HPP's name in public. You and the 2 other terminated employees may not care about that not owning in HPP but I would think the 1 terminated employee would care about the value of his HPP properties.

I own property and my name is not on the deed. I still own it and pay taxes on it. It is held in my family trust. There are other ways to legitimately own property and not have your name on the deed as well.

Be not too quick to jump to conclusions with minimal information.
Assume the best and ask questions.

So you must have title to the property then.

Per HPP Bylaws:

Article VI - Membership and Voting (a) "The owner of any lot upon acquiring title thereto shall automatically become a member of the Association and shall remain a member thereof until such time as ownership ceases for any reason, at which time membership in the Association shall automatically terminate. Lot owners shall include all individuals and entities (partnerships, corporations, limited liability companies, limited liability partnerships, and trusts) holding legal title as tenants-in severalty, tenants-in-common, joint tenants, or tenants by the entirety."

But James Weatherford stated, "About my 'membership'. Correct, my name is not on a deed. Never said it was."

Sounds like he's saying he's not an association member here. Maybe James can clarify on his statement.

The county tax records clearly indicate that the property in question is solely in the name of Elizabeth Weatherford. There is no mention of any trust, ownership in severality, or any other form of joint ownership. Therefore James Weatherford is not a member of the HPPOA. He is certainly entitled to an opinion, but participation in association business is another matter.

To be perfectly clear: my name is not on the deed of either of the two properties in HPP with Elizabeth's name on it. I have never claimed other wise.
Since it seems of interest to someone, I began attending and participating in HPPOA meetings as a result of repeated insistence by an HPP member who used to be very active in HPPOA, Neighborhood Watch, etc. (I guess he is a member, and do not know if it is his name, his partner's, or both on the deed). I told this person that Elizabeth's name was in the deed and not mine. He told me not worry, that didn't matter. Perhaps he thought family was important.

Yes all public information. Go to the state judiciary website and search the court cases.

I found it in under 5 minutes. and that was without case #.
