The problem with building codes is how they are enforced.

Or not enforced, as the case may be; the threat of enforcement is a really inexpensive way to keep the marginal population "in their place".

make it impossible for persons of modest means to afford to build legally permitted structures

That's exactly the point -- those "persons of modest means" aren't the ones lobbying for building code upgrades.
