Presumably we don't want ANY aircraft flying as low or close as some of these tour helicopters do.
One technical solution may be to mandate earlier ADS-B deployment in helicopters flying over Hawaii. All planes have such a transponder, and anyone on the ground can pick up and log their flight with a laptop and about $30 worth of equipment. It could keep them honest about altitude and route.
