A lot of this discussion, the interpretation of legal details, or misinterpretation of legal details, reminds of the people who claimed there was no binding legal requirement that you pay taxes, or the Native Hawaiians who flew to The Hague and discovered some international loophole proving paperwork wasn’t properly completed or filed or another claim.

The anti tax people usually were fined or jailed.  The international legal researchers generally had no standing in the courts for their efforts.
