Jeff, they do cite for terroristic threatening, in fact I had a NFH who threatened my son in front of his wife and she called the police ... BUT the only reason they cited the guy is because their was an impartial witness. Actually a witness who worked FOR the other guy who supported my son's story. Up until that point, the stories of five people on the scene were balanced out as He Said, She Said.
I'm sorry but an unwitnessed incident will not amount to anything.
As for damages, it is very very difficult to collect for emotional distress without supporting medical treatment of physical ailments ... and if you claim it, their attorney will have the right to all your medical records and will try to paint a picture with them.
Neighbor harassment is a claim that both parties flip on the other, even though you didn't harass them, they would counter-sue that you did and the "facts" are not weighed until later, after tons of money spent, you have your day in court ... which they will pressure you to settle out anyway.
this is not a good scenario.
Personally, I would move.
I have left places that I loved because I realized the neighbors from hell would never let me be even moderately happy there.
Just wait until you build in front of their patio ... clearly your right to do so has not sunk into their brains and never will.
Don't let this eat your life by taking it on!
