HPP Board 2014
Another excellent addition to the debate, mermaid 53, thank you. As I don't have access to the Conduct Policy, it may take me a little while to comment appropriately on what you have raised.

It now appears that what had seemed to be gratuitous criticism of the Board, which raised the ire of many of the Board's original supporters, was not unwarranted. And that thinking, caring members have begun to put their creativity and energy into finding solutions. This, too, is appreciated.

Yes, finding solutions is our goal! I appreciate that the tone of this thread is getting a lot more productive. I really think we, as a community, have more in common than not. Our goal is a healthy, legal Association. If we work together instead of against one another, things just might just get straightened out. Please keep it up! We can fix this, together!

The answer on enforcement is simple. Since the board police's its self currently their is a section in the bylaws regarding arbitration for conflicts.

Change the bylaws to say that when there is a conflict that our lawyer reviews the situation and recommends the next step or becomes the arbitrator.

The directors can't police their own actions!

So after almost 4 months of opportunity to do the right thing, after hundreds of posts, and all the personal attacks and name calling, even accusations of pet murder, the board supporters who accused reasonable people who just asked for accountability of undermining the board and supporting the fired employees, are finally now noticing that this board is running amuck! Really, what finally cued you in?

The solution is not to hire a professional board (they would still need oversight by HPPOA members), there are huge non profit organizations with volunteer boards that operate very successfully, they just follow the bylaws, set policies, and then get out of the way and let the paid employees run things. The board shouldn't be a paid management company but it does need to get its big nose out of day to day operations, hire replacements for the fired employees, and start to take care of board responsibilities like following the bylaws and state and federal law for boards and employers, which includes basic things like not revealing confidential personnel information about current or past employees in public meetings or internet forums, so the HPPOA doesn't get sued, posing accurate minutes, and filling vacant seats by following the by laws. How hard is that?

Where is the "conduct policy" posted on the HPPOA website?
I cant locate any "policies" of HPPOA on the website.
Are the policies available for the membership to view anywhere?

Board supporters were hoping this time, this board, would be bylaw abiding individuals. After the terminations I was hoping they would learn our bylaws and get on track from that point on. The opposing faction was so disrespectful, volatile and aggressive and that was unacceptable to me. I continued to support the board during those days because I admired their resilience despite the hammering they were receiving. No volunteer deserves that kind of treatment. The opposition also made mistakes and pitted neighbor against neighbor..a horrible time for all of us.

As mentioned in a previous post, several of us tried to tactfully assist in guiding the new board and as time went on a couple of the exec members began to consider us a nuisance. It seemed that a couple of the exec members of this board, like previous boards, became arrogant, thinking they were entitled as exec members to exclude and disregard the voices of other board members and lot owners in their decisions.

My position of expecting that our bylaws should be followed resulted in my having to resign from the HRC. Add to it a conflict of interest. The other members on the HRC seemed to be unconcerned as nothing changed-a red flag for me. 3 of us were appointed, refer to July 2014 Minutes and only 1 of the 3 appointed are left. The appointed board member was excluded for the 1st 3 meetings, by another board member who remains on the HRC. I asked for an explanation and have received none. The appointed board member resigned after me. None of it was personal, I just wanted them to follow our bylaws.

After the final act of decommissioning the RTSC and the manner and reasons it was done has put me where I am today. In realization that we need to be proactive in solving this vicious cycle of board members habitually breaking our bylaws w/no accountability. Otherwise, what good are our bylaws?

I am a supporter of law abiding board members and want to make sure to recognize that on every board of directors, there are those that try their best to follow our bylaws. It's frustrating for them to fight the treacherous current of those that arrogantly break them. I admire their resilience and tenacity, such as our steadfast treasurer, and wish them all the best of luck, including our newest board members.

I believe you can ask someone in the office to provide a copy of the Conduct Policy.

In fairness you might want to change that to SOME OF "The opposing faction was so disrespectful, volatile and aggressive and that was unacceptable to me. " There are many reasonable voices throughout this thread who voiced concerns and were then accused of so many outrageous things that they all quit posting here. Some of the die hard board supporters were very offensive, even harassing one person at her work email.

This board has broken laws governing employee confidentiality, ignored bylaws right and left, and ignored the voices of all who disagreed with them, all the people who blindly supported them, no matter what they did, ought to volunteer to cover the financial costs the whole HPPOA membership is going to be stuck with due to this board's arrogant actions.

On top of everything else, the roads are getting rutted and pot holed, stop signs aren't being replaced at high traffic intersections when vandals knock them over, and the grass is 6 feet tall at many intersections. But that $90,000 piece of equipment they bought with no real discussion is going to fix all that, right?

Both the HR Handbook and Conduct Policy are confidential and if your not a member of the HR Committee or a director you are not privileged to this information. Sorry.
