Candidate Eligibility
Glad I live in District 4 !!

2012 was the election where Tiffany went after Jamae Kawauchi with a vengeance pursuing any hint of possible voter fraud. That same election, Hunt knowingly committed voter fraud, when she registered to vote in District 4 when she resided in District 5 in Hawaiian Acres. She managed that by falsifying her place of work, her husband's surf shop, as her residence. (Something about how hypocritical that she published many articles attacking the County Clerk and making insinuations about her, when her own hands weren't clean at all.)

2012 Hawaii Revised Statutes
TITLE 2. ELECTIONS
19. Election Offense
19-3.5 Voter fraud.

Universal Citation: HI Rev Stat § 19-3.5 (2012)

§19-3.5 Voter fraud. The following persons shall be guilty of a class C felony:

(1) Any person who knowingly registers another person to vote when that person is not entitled to register to vote;

(2) Any person who knowingly votes when the person is not entitled to vote;

(3) Any person who knowingly takes an oath in this title prescribed or authorized by law and wilfully makes any false statement of fact while under oath therein; or

(4) Any person who wilfully makes a false answer to any question asked of the person while under oath in this title prescribed or authorized by law. [L 1990, c 115, §2]

Yes: the "letter of the law" is what "should" happen.

However, "a determination was made" by the County Clerk -- exactly as I suggested would earlier in this topic. It remains to be seen what "determination" will be made for the (very similar, if not identical) situation with Gonzales.

If Tiffany lists the surf shop as her residence, then is that also a zoning violation?

If the surf shop is zoned Commercial, yes; if it's actually R+SUP like similar properties in downtown Pahoa, then the Zoning folks will have to "make a determination".

You should remember that Tiffany played a role in the current County Clerk getting her job.
Assume the best and ask questions.

I do not believe it is a zoning issue. It is a voter fraud class C felony issue. Tiffany claims to have been living in Hawaiian Acres for many years yet she changed her voter registration card and voted in District 4 while living in District 5. So we should get it straight before we move on with the discussion.

Also, there is the matter of not paying her general excise tax on the property in Hilo. In the tribune article today Tiffany is quoted as saying that she has been renting her property in Hilo. This dear readers is yet another attempt to get away with not paying your taxes. Tiffany is a tax evader and guilty of voter fraud and I am picking up a copy of her 2012 voter registration form today and taking it over to the tribune. Lets see if they find it interesting. if not there is always the punaweb.

The tribune is suppose to cover the story not cover it up. The tribune forgot to mention the fact that according to the county clerk correspondences on this issue he states that although we missed the 60 day deadline there is a remedy should Mrs. Hunt be elected. Mr Medea's wrote these words at the end of his letter which the reporter neglected to cover.

"You also inquired as to the appropriate remedy if the candidate objection deadline has passed, the candidate in question is elected to office, and it is later determined that the person did not meet the residency requirements at the time of the election. Please be advised that the Hawai'i County Charter Section 13-1(f)(3) provides that any elective office shall become vacant upon the determination made by the county clerk that the officer was not a duly qualified immediately preceding the election or appointment."

These are all separate violations.

1. Claiming resident property tax exemption without actually residing on the property.

2. Claiming residency elsewhere in order to be eligible for public office there.

3. Claiming residency elsewhere in order to vote on local issues there.

4. Possibly neglecting to pay GET on rental income; maybe this includes TAT.

5. Potential zoning violation.

If our elected County officials are unable or unwilling to prosecute whichever apply, then the precedent is set for all: tax evasion is okay, zoning is irrelevant, voter fraud permissible.

"Officer, I wasn't cognizant of the speed limit."

kalakoa, I take back everything I ever thought about you :0) You are an honest individual and you hit the nail right on the head. Now how many of these items will Tiffany be able to wiggle out of?

All of them:

remember that Tiffany played a role in the current County Clerk getting her job.

It's "how things are done" here.
