Here is my take on the meeting, as a first time attendee of HPP owner meeting:: I will comment on my experience at end of post.

There seemed to be a BIG turnout, not sure what attendance was but guesstimate over 150, most people I would think came looking for concrete FACTS ( unfortunately I left meeting without these, not sure if this was others' experience).

There were TWO agendas handed out as you went into meeting-- one from the " cabal that hijacked" ( a prevoius post's term, not my term)the meeting and ? the other was from the board.

When the meeting started, a gentleman stood up and presented a motion that " the cabals" agenda be accepted without introducing who he was or how agenda was arrived at ( obviously, there had to be a meeting to put together this agenda but who/ how many people were involved). This motion was passed by a broad majority and hence the meeting jumped right into unfair dismissal of employees.

A motion was proposed and passed that mediation would occur, rather than litigation. No member of board is to be involved in this mediation, 5 members of owners are to be chosen ( but there was no discussion on how these 5 individuals would be chosen, my sense is that they are already chosen!!). During this discussion, one of the board members stated that " mediation is already occurring ".

[Mediation does not mean that litigation will not happen, if mediation fails, then it could progress to litigation, is my understanding.]

Then an INCREDIBLE amount of time was spent on the motion to release this boards executive meeting discussions, which was then amended to ALL executive meeting from past and going forward( it was apparent that there were axes to grind with previous board also!) Luckily, good sense prevailed and this motion was not passed.

The BOARD was then given the floor for 15minutes, only one board member chose to say anything ( I do not know her name, as they were not introduced-- it was assumed all present knew them). I can't remember the specifics of what she said but do remember that she stated that when this is all over and completed, she gave a personal commitment to discuss the details of firings.

A late motion ( when majority of people had left) asking for board to step down was passed.

Now for my thoughts about meeting, these are my PERCEPTIONS, everyone present will have their own.

1...The board should have been ALLOWED to present the details of the firings, at the outset of the meeting, then all present would have the same information. As it was, no one knew the same details, it was presented during meeting that people were taking kickbacks from a company, but I have no idea if this is factual or not.

2... The "cabal" kept referring to Roberts rules but as previously stated did not abide by them. Furthermore, the agenda developed was developed without all owners input... If it was truly representative of what owners wanted discussed, we would all have had input into it.

3... There was a general tone of disrespect for each other... I kept thinking that i don't believe that people are behaving like this...Shouting, talking over when someone at the microphone talking, board member " screaming" , it felt unsafe, as if physical fighting could have started at any time( maybe that was the plan, I'm not sure)and on and on and on.

I left the meeting before the end ( as it was 8.45, another rule of effective meetings broken, END when you say you are going to which would have been 8.30) and outside the door, there are 5 policemen---when I asked them if this was usual or unusual for a home owner association meeting, one said " this would be unusual".

So not a very informative meeting if you were looking for some facts about this whole fiasco.
Finally, I think there is so much animosity to this board that I am not sure how they are going to be effective in their jobs.

What this group headed by the x-president of the previous board is focused on is bylaws and Roberts Rules. Hypocrites! They sure didn't follow rules or bylaws last night.
They even suggested hiring a parliamentary professional to attend board meetings to educate the new board on Roberts Rules and following the bylaws...
What about the x-president? Why isn't she mentoring and guiding the new board members on proper procedure? Oh, that's right, the x-president wants this new board to fail so she can get her cronies on the board and get her power back. So the x-president just watches for the new boards mistakes instead of helping the new board learn the bylaws.

The threat of a lawsuit is the only reason most of the uninformed folks turned up at the meeting. Scare the owners and get the new board out...

Interesting thing about lawsuits; Lawyers get all the money and plaintiffs need to prove damages.

correction, confirmed today:
The letter from the attorney of the 6 directors, proposing mediation, was mailed on Sep 5 and received on Sep 8. So, they were notin mediation before the meeting last night.

Had it occurred to you that the Board Members already knew they were on the path of mediation prior to the meeting through conversation with legal counsel. Are you really that far out there that you think the news has to come in the form of a letter?

I spent hours pouring over the conversations here last evening and after the prior meeting. I attended the 09/07 meeting and here is my observation:
The Ex-Presidents's Coven could not be more obvious as to what their agenda was/is. Shame on you for your behavior and shame on you for making a mockery of the "Owners Meeting". It was obviously orchestrated in bringing chios to the meeting and to create havoc. Dominating the speakers with the same rhetoric. Blah Blah Blah. You totally wasted my time that I will never get back. Spending your days wondering how to bring down this new Board is nothing but shameful and really quite sad. I observed your little clan running back and forth to one another spewing your poison. I had a great seat on the stage and couldn't help notice the man with the yellow neighborhood watch t-shirt. Please oh please tell me he is not a committee member of the neighborhood watch...if so, no thank you. I am not sure the Board has done things correctly or followed the by-laws, what new Board has? I have to agree with a previous post in which it was stated "why isn't the ex-president helping and guiding"? Well, it is because she seems to want the Board to fail. I am totally convinced of this. My husband and I have been and are appalled while watching her sitting at the front table enjoying every moment of the chios. We have lived in HPP for some 25 years so before anyone accuses us of being on the Board or any association of the Board, we are not. We had a front row seat to the 2 last meetings and this is our observation. For the "Coven", please put your energy toward something useful. Let the misguided , NEWLY ELECTED Board get down to work. If you aren"t helping, get out of the way. If you are going to help without an agenda, I am certain this will be a better community.

You know, reading through this and other posts about HPP makes me glad to own in Orchidland. I really wanted the roads paved up there, and voted for it, and would gladly pay for it- but if this is how things "get done" in Puna, then I am glad our vote didn't pass. Why on earth isn't there more cooperation? This is insane. How hard is it to actually pave some roads, follow a meeting agenda, etc.

I was not at this meeting, but my husband was, and I think there is an unfair lumping together of everyone who does not agree with the actions of the current board happening in the reports here. There may be a group who is coordinating actions together, but not everyone who disagrees with, or is disturbed by, the actions of the board are part of a "coven" or "cabal". This sort of loaded language is being used to diminish the concerns of many, many members of the HPP community who are not part of a group or conspiracy, but are concerned that some of the actions of this board are not responsible, legal or ethical. These people who hide behind fake screen names and accuse concerned members of HPP of being "cabal" or "coven" members seem to be mostly interested in covering for this board, not solving the problems facing our community.

Calling people names like "cabal" and "coven" serves no purpose and is inflammatory. I know my husband did not coordinate with anyone else before going to this meeting and he was allowed to speak several times, he also said that there was a lot of abuse of Robert's Rules of Order on the part of many people there, including the facilitator who did not understand the process of how motions and amendments are discussed and voted on.

It is my opinion that this small group of malcontents were planing to out most of the current board before they even took office. June started the petition for the meeting. Yet she did not say a thing at the meeting. She started this. She needs to take responsibility for what she did. She needs to put a stop to this. And do what is best for HPP.
At the next board meeting if you are near one of the malcontents ask them to be quite so you can hear what is being said. If they do not, ask the board to have them removed from the meeting.
