HPP Board 2014
This topic reminds me of a Frank Zappa song titled: "The Torture Never Stops"
Assume the best and ask questions.

Could this topic be "quarantined" to another Forum of it's own? such as "Subdivision Blues"?

Anyone considering purchasing property in HPP...

This illustrates the problem I have with "buyer to perform due diligence" -- just how much diligence would the prospective buyer need in order to discover the dysfunctional board?

." You're assuming again that I haven't said anything to the Board."

(NOPE, had hoped you had done so and wanted you to tell us.)

"It doesn't matter to them what I think and I've been told so by one of them. It would take owners speaking on behalf of the RTSC to make any difference in how this board thinks about their improper actions."
------------------------------------------------------
Geez, finally . Thank you ! How can the owners really know what happened much less speak out for our RTSC if we are not told what really occurred?

So agreed ? common ground , bylaws not being followed?, Process being ignored equals a Frank Zappa song?

We have a full Board again! There were 5 new BOD sworn in at last night's meeting.
Each of the 5 spoke a little about why they wanted to be on the BOD.

The full BOD voted unanimously to NOT raise the annual road fees!

Not so fast! Can't you read the bylaws!

The board violated the bylaws Again!

ARTICLE VIII-BOARD OF DIRECTORS
Section 6 Vacancy
"Vacancies in the board shall be announced within two business days on the HPPOA website and bulletin board".

Since the resignation for District 1 was announced last night and not posted, owners in the district that wanted to run for the board could not. That is not fair to all of district one.

The web site only had 4 openings on it not 5.

This appointment will have to be held at the December meeting any votes cast by this illegal appointment will have to struck from the record.

The Neighborhood Watch committee received a letter from the board informing them that they are no longer a committee of HPPOA and they were on their own. When was this voted on?

Or the letters to Joan and John to band them from HPPOA property.
Without a TRO they have NO authority to ban any owner from property that they are entitled to use by the bylaws.

hppwatchdog is correct that the fifth appointment is not valid.

Although the Board did not announce when the resignation of the Director for District 1 became effective, some time must have elapsed before the 19 October meeting because there was a candidate ready for appointment. There was also no urgency to rush this matter through, as there were four valid candidates for appointment, bringing the total to 8 members, and most likely ensuring a quorum for any future meetings. Therefore, there was time to post the vacancy on the website and add the last member at the December meeting.

However, hppwatchdog fell slightly short in the estimation of the number of candidates who could have applied to be considered. Since it is an appointment, not an election, candidates can be drawn from all members, without regard to district.

It has been 5 1/2 months since this Board took office; it is no longer "new". There have been more than numerous occasions brought to its attention when it has ignored the Bylaws and that this is not acceptable. The Board has actually taken some of the "suggestions" and amended its actions to comply.

Is it not time to expect that the Board will, at the least, read those sections of the Bylaws related to matters it is considering BEFORE it takes decisions?

I know someone is going to ask,did they have a quorum when they appointed the new board members?

A quorum for this particular issue is not required:

"Article VIII - Board of Directors, Section 6. Vacancy. ... They shall be filled by vote of the majority of the remaining directors, even though they may constitute less than a quorum, ..."
