I guess you only say there are no reasons as bait.
When someone posts the reasons given in HPP meetings and posted in the HPP minutes, then you pounce on them, threatening to have them involved in the lawsuit.

Look back just 1 or 2 pages on this thread to see many defamatory, exaggerated false statements about the Board members by Steve1 and HPPwatchdog.

Guess it is ok for the FES (fired employees support group) to make up lies, defame, call names and spread rumors about the HPP Board.

As evidenced by posts on this thread, anyone who does not support the fired employees is bullied.

It's obvious that you don't get it.

The termination letter has no reason for termination, I read it.

Any reasons after that have no merit in court.

But that's not even what the law suit is about.

hppwatchdog is correct. As the employees' contracts were "at will", the Board needed no reason to fire them (and, according to one former employee, no reason was given at the time of termination). [This was not the impetus for the first part of the lawsuit - see "Counts 1 and 2 Unlawful Discharge".]

Why would Board members later make critical statements about the former employees in public? Under the Bylaws and State and Federal law, all that had to be said was "we felt it was time for a change".

All those critical statements were made in contravention of State and Federal laws protecting employee confidentiality. Even if there is proof to support those statements, they cannot be made in public outside a court of law. [This is what brought about "Count 3 Defamation and Count 4 False Light".]

And anyone repeating those statements in public is equally guilty of breaking those laws.

Terry Mclean was appointed as the acting interim General Manager after the employees were terminate he is also named as an individual in the law suit.
He has no standing to be defended by the Association or our insurance company.

ARTICLE XVI-MISCELLANEOUS, Section 3 states:

“The Association shall indemnify and defend every director, officer, its executors and administrators, including the General Manager.”
And (b) “a representative of any entity or organization which engages in any joint management or operation of the Association.”

According to the bylaws he must bear the cost for his own defense.

This topic needs to be brought up at both the Dec. board meeting and put on the agenda for the Feb. membership meeting, I don't want to pay for his defense.

As hppwatchdog states, the Bylaws only make provision for the indemnification of one employee, the General Manager. This appears not to cover the case of a volunteer acting in that capacity.

I do not have access to the HPPOA insurance policy that covers this indemnification and, thus, cannot judge whether Mr. McLean would be covered under it. I suspect not.

If not, hppwatchdog has fallen short in his appreciation of what the Association is NOT responsible for. It would neither have to pay for his legal representation nor for any judgment against him or his share of any settlement.

It seems HPP will be paved by Pele pretty soon. Hope not, but it will solve your dust problems.
