Scott Nago Solves Democracy Crisis With Magic Basket of Destiny

OK, events elsewhere in the country couldn't possibly be related to, or otherwise affect, Hawaii. Good to know.

I still think you're trolling and stand by that opinion.

Thank goodness The High Court is wiser than our more prolific posters.

Eddins wrote these words:

“The right to vote means little if the result cannot be trusted. Here it could not. So the voters will settle it.”

"The court...determined that the state did not follow proper rule-making with the method it chose to conduct the tiebreaker — by placing the names of each candidate in plastic Easter eggs and then having one drawn from a lauhala basket. Therefore, the tiebreaker was invalid."

And yet, the show goes on, and on, and on...

As I said.. back on post #22 of this thread..

As to how to break ties in primary elections.. it is a no brainer.. redo the vote in the general election between to two that are tied. It's an election, let the folks elect. If it's a tie in the general, hold a special election. Simple. And nobody, nobody, could bitch about it. Except the bean counters, obviously.

To your credit, you did say that MyMan! which, like The High Court, makes you wiser than our more prolific posters.  Perhaps approaching a lower bar, but, praiseworthy all the same.

Justice Lisa Ginoza wrote in a separate opinion that the court found two problems, either one enough to void the result.

The first was two ballots cast by District 40 voters who were mistakenly issued District 43 ballots and folded into the count with no way to trace how they voted. The court rejected the state’s argument that Souza had to prove which way those ballots broke.

“A tie must be real before it can be broken. Two ballots from outside the district put this one in doubt,” Eddins his opinion joined by Acting Chief Justice Sabrina McKenna.

The justices held that in an ordinary contest, a challenger has to show enough tainted votes to overcome her opponent’s lead. But a tie has no lead to overcome, so any unaccounted-for ballot is enough to unsettle it.

They also put the burden of proving the two ballots were validly cast on the state, not on Souza, relying on a Hawaii statute that treats official election records as presumptive evidence.

“The margin is the filter,” they wrote.

Yes, Nago screwed up more than just the plastic egg/ magic basket debacle.  Mahalo for posting more of the Clown Show.  Wink

When challenged about the extra ballots (again?)  *IN A TIED ELECTION*,  Nago said they were, "negligible".  Glad The Court disagrees.

You know, brother 'Tang, all along you could have just shined a light on the positive..

"Hey, as did the court, one of our own said..."

But instead you went with the negative...

"Thank goodness The High Court is wiser than our more prolific posters..."

It really is just a choice.

MyMan! Mouthed: But hey, now that the [ Expletive rule breaking that always goes unnoticed ]...

You should leave Josh Green out of this.  Our Governor is too busy on his frequent trips back to to DC to be involved in this.  He isn't the one who screwed all of this up.  That falls squarely on Scott Nago - The Cheif Elections Officer of Hawaii.

Traveling man: Hawaiʻi Gov. Josh Green just wrapped up his third trip to Washington, D.C., this year to advocate for national health care issues. This one also on Hawaiʻi taxpayers’ dime despite combining the trip with political business for the new political action committee the governor launched the last time he was in D.C. at the public’s expense.  -  By The Sunshine Blog
