We relied upon the required inspections...however, there were no cracks at the time, and the refacing of the slab was not something that is obvious. This house and yard were clean as a whistle. I do not believe we were remiss in not hiring a private inspector since this was a newer home and as I said very clean.
Not until the decomposition of the green waste did the cracking and sinking start. The albezias were HUGE and it makes sense that it took the time it has to be so noticeable.
I can understand your desire to have so many inspections done. Your property is far more upscale than ours to be sure, Devany. We do not have the means to perform the type of investigations that might seem logical and typical to you. You are blessed to be sure.
In any case, this is speculation and after-the-fact. We are now in a phase where the hope of remedy rests on how vigilant we can be with our investigation and pursuit of the process that took place during the building and sale phases.

Oh as MANY have intimated here the questionnaire aka disclosure form and the home inspection are only as honest as the people doing it, or as informed as the people doing it are educated, either by the current homeowner, or the building education and experience of the inspector.
It's all a lot of good faith and good will. Honesty is necessary and karma is tough for those with a conscience.

We will be finally filing our complaint with the DCCA. We are hoping that something comes of this, if only attention to the matter of bad ethics in green waste burial. Still hoping to raise the funds for an attorney...that will be a slower process. Thanks for all your kind words.

You are pretty much wasting your time. They take 3-4 years to investigate a complaint and their "punishment" is usually no more than a slap on the wrist.

You are right Carrie, I just wanted you to be prepared for the outcome. I have been involved with a few RICO cases, so I know how that system works. In fact, one of my cases was so serious that DCCA filed a lawsuit against the individual on my behalf and I now have a $48,000 judgment in my favor. I would be happy if I could collect, but in reality it's just a piece of paper.
Yes, I know someone you know. I remembered that Tony works at Toyota, so when we were in Puna a few weeks ago I mentioned it to the person we both know. Small world, huh!?

Seems like a judgment that size - shouldn't there be a way to collect? I mean, don't they have to pay or suffer consequences?

The guy never showed up in court to defend himself and nobody knows where he is. (DCCA got a default judgment for me.) Just one of those fly-by-night operators.

The judgment is the easy part the collecting it another matter.
"Pretty Salty" I meant gritty! The crux or meat of the problem was stated in pages 2-5. The thread was over a month old.
John in Hawaii what inspections do lending institutions require when making a loan for a residential property? Are contracts written for AS IS required to be paid fully in cash?
Devany what a cool idea an independent house inspection complete with video! WOW! Did your personally contracted house inspector find any significant problems on your property? Did the video show any problems later? Interesting comparison that would be for future use.
This is so cool like documenting possessions, or collections for future needs, fire, earthquake, flood, burgulary, termites, tsunamis and lava tube collapse.
As this inspection issue seems like several issues in one, depending on type, and then throw in the permitting and finals which may or may not have been done and left for discovery down the road, looks like people would need a road map to buy an existing structure, and also for purchasing raw land for it's unique problems. Hum.
